ORDINANCE NO. 2001-10- L4ef-7
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO
AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH AND
AMERISOURCE CORPORATION FOR AN ENCROACHMENT UPON A PORTION
OF CITY RIGHT-OF-WAY ON MADISION STREET
WHEREAS, Americsource Corporation is the owner of property located at
322 North 3rd Street; and
WHEREAS, the City of Paducah is the owner in fee simple of a portion of
Madison Street right of way located adjacent to Amerisource Corporation; and
WHEREAS, Amerisource Corporation is desirous of encroaching upon
and utilizing a portion of the right of way of Madison Street to construct an enclosed
pedestrian area; and
WHEREAS, Amerisource Corporation has committed to relocate the
existing sidewalk, curb and gutter and install grating for proper drainage within this
vicinity in order to facilitate the construction of the enclosed pedestrian area; and
WHEREAS, the City of Paducah is desirous of permitting the aforesaid
encroachment by Amerisource Corporation; and
WHEREAS, the City of Paducah and Amerisource have now entered into
an agreement pertaining to the foregoing and do desire that the same be set forth in
�;. writing and be made part of the public records of the City of Paducah, Kentucky, and
recorded in the Office of the County Clerk of McCracken County, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized to enter into an
Encroachment Agreement with Amerisource Corporation for the installation of an
enclosed pedestrian area to be located along the south right of way of the 300 block of
Madison Street also being located adjacent to Amerisource property located at 322
Madison Street.
SECTION 2. This ordinance shall be read on two separate days and will
become effective upon summary
