At a Regular Meeting of the Paducah Board of Commissioners held on Tuesday, April 27, 2021, at
5:30 p.m., in the Commission Chambers of City Hall located at 300 South 5th Street, Mayor Bray
presided. Upon call of the roll by the City Clerk, the following answered to their names:

ORDINANCE ADOPTION
APPLICATION - ENTERTAINMENT DESTINATION CENTER IN DOWNTOWN
PADUCAH
Commissioner Guess offered motion, seconded by Commissioner Gault, that the Board adopt an
Ordinance entitled, “AN ORDINANCE ESTABLISHING AN ENTERTAINMENT DESTINATION

CENTER IN THE DOWNTON OF PADUCAH AND FURTHER DIRECTING THE CITY OF
PADUCAH TO APPLY FOR AN ENTERTAINMENT DESTINATION CENTER LICENSE FROM
THE COMMONWELATH OF KENTUCKY DEPARTMENT OF ALCOHOLIC BEVERAGE
CONTROL AND FURTHER ESTABLISHING THE REQUIREMENTS FOR LICENSEES TO
SELL ALCOHOLIC BEVERAGES WITHIN THE ENTERTAINMENT DESTINATION
CENTER.” This Ordinance is summarized as follows: This ordinance creates new articles in Chapter
6 of the City of Paducah, Kentucky Code of Ordinances to define the geographic boundary of a new
Entertainment Destination Center in downtown Paducah and authorizes the City of Paducah to apply
to the Commonwealth of Kentucky Department of Alcoholic Beverage Control for an Entertainment
Destination Center license. Further the ordinance outlines the participation requirements for alcoholic
beverage licensees located within the EDC boundary. Pursuant to KRS 83A.060(9)(c), the following
full text shall be published: A new section shall be created in Chapter 6 of the City of Paducah,
Kentucky Code of Ordinances which shall be titled “EDC Fees” and to state as follows:
(a) All ABC licensees participating in the EDC shall be required to pay a yearly fee to City of
Two Hundred Fifty Dollars and no/100 ($250.00). This payment shall be due and payable on
or before July 15 of each year.

BUILD GRANT ENVIRONMENT ASSESSMENT – CHANGE ORDER #1
Commissioner Henderson offered Motion, seconded by Commissioner Wilson, that the Board adopt
an Ordinance entitled, “AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE CHANGE ORDER NO. 1 WITH BFW ENGINEERING & TESTING, INC. TO
INCREASE THE CONTRACT BY $12,200 FOR THE BUILD GRANT ENVIRONMENTAL
ASSESSMENT.” This Ordinance is summarized as follows: This ordinance authorizes the
execution of Change Order No. 1 with BFW Engineering & Testing, Inc., for an increase in the
amount of $12,200 and a new total contract cost of $262,200 related to the BUILD Grant
Environmental Assessment. This Change Order allows for BFW Engineering & Testing, Inc. to
engage the services of a third party to provide mussel surveys along the shoreline as part of the US
Fish and Wildlife Services analysis of the impacts of the proposed project.

ANNUAL OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2020, THROUGH JUNE
30, 2021, BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS
FOR THE OPERATION OF CITY GOVERNMENT.” This Ordinance is summarized as follows:
That the annual budget for the fiscal year beginning July 1, 2020, and ending June 30, 2021, as
adopted by Ordinance No. 2020-6-8641, be amended by the following re-appropriations: Transfer
$154,000 from the Debt Service Fund Reserve to the Investment Fund IDA Account.

DISCUSSION
Communications Manager, Pam Spencer, offered the following summary:
Commission Priorities
Assistant City Manager Michelle Smolen provided an update on the first quarterly report of the City
Commission Priorities. In February, the Board selected 12 priorities to improve and enhance
Paducah. To provide feedback on which priority means the most to you and why and for a chance to
win a $250 gift basket, please take this survey by 4:30 p.m. on April 30.
The Board also discussed the available $19.75 million in bond proceeds and possible
projects: Barkley Regional Airport; 911 projects; outdoor sports and recreational facilities;
stormwater projects; Southside enhancements; and City facilities. The City and County have
tentative plans to hold a joint meeting next Tuesday at 5 p.m. to discuss the proposed outdoor sports
complex.
Further discussion by the Commission regarding the Outdoor Sports Facility and the City’s
partnering in some form. The Mayor has proposed having a Joint meeting with the County
on Tuesday, May 4, 2021 at 5:00 p.m.

Thanked the City Manager, Mayor and Staff for their hard work to make Commission
Priorities a reality
Rev. Alford Anderson and Lincoln Heights Baptist Church will host a meeting where he will
have a community discussion about city priorities and issues. May 3 @ 6:00 p.m.

Vaccines are available. Urges everyone to get vaccinated so that we can get the economy
open again.
“Returning To Tourism” webinar will be Tuesday, May 4, @ 9:00 a.m.
The American Queen has returned to Paducah and will soon be allowing passengers to
disembark and tour Paducah.

Background Information: The U.S. Department of Justice (DOJ) Bulletproof Vest Partnership (BVP) Grant
Program, an online application, provides a maximum 50-percent reimbursement for the purchase of body armor
for police. The City received $6,330 in 2018 and $4,367.71 in 2019 from this program.
The National Institute of Justice, the research, development and evaluation agency of the United States
Department of Justice, sets the only nationally accepted standards for body armor worn by law enforcement
officers. NIJ recognizes an industry standard of a five-year life span on body armor. The DOJ BVP also
recognizes a five-year life span on body armor. Due to these industry standards and endorsements by the
preeminent law enforcement agencies, the Paducah Police Department follows a five-year replacement plan on
body armor worn by law enforcement officers.
The Police Department applied for this grant under Municipal Order 2346 and was awarded the grant in the
amount of $5,506.90. This grant requires a 50% match, which will be provided from the FY21 operating
funds.

WHEREAS, the City of Paducah applied for a 2020 U.S. Bulletproof Vest
Partnership Grant in the amount of $5,506.90 through the U.S. Department of Justice, adopted
by Municipal Order No 2346 on June 9, 2020, to be used for the purchase of body armor vests
for the Paducah Police Department; and
WHEREAS, the U.S. Department of Justice has approved the application and is
now ready to award this grant in the amount of $5,506.90.

SECTION 1. That the Paducah Police Department is hereby authorized to draw
down grant funds as acceptance of grant conditions for a 2020 U.S. Bulletproof Vest Partnership
Grant through the U.S. Department of Justice in the amount of $5,506.90 to be used to purchase
body armor vests for the Police Department, and authorizing the Mayor to execute all documents
related to same. The 50% local match of $5,506.90 will be provided by the Police Department’s
FY2021 operating funds.
SECTION 2. This order shall be in full force and effect from and after the date of
its adoption.

Background Information: The U.S. Department of Justice (DOJ) Bulletproof Vest Partnership (BVP) Grant
Program, an online application, provides a maximum 50% reimbursement for the purchase of body armor for
police. Over the past few years, the City has received $6,330 in 2018, $4,367.71 in 2019, and $5,506.90 in
2020.
The National Institute of Justice, the research, development and evaluation agency of the United States
Department of Justice, sets the only nationally accepted standards for body armor worn by law enforcement
officers. NIJ recognizes an industry standard of a five-year life span on body armor. The Department of Justice
BVP also recognizes also recognizes a five-year life span on body armor. In light of these industry standards
and endorsements by the preeminent law enforcement agencies, the Paducah Police Department follows a five-
year replacement plan on body armor worn by law enforcement officers.
The Police Department is requesting 25 body armor vests for officers from the BVP Program for a total cost of
$16,196.75. The Police Department is basing the cost of each vest on the state contract price of $647.87 each.
This grant requires a 50% match; therefore, the Police Department will request $8,098.38 from the BVP
program and provide $8,098.38 from FY22 operating funds.

Background Information: As part of the Investment Fund Decision Items for FY2021, the Commission
approved appropriation of funding for the Paducah Junior College, Inc., scholarship program in the amount of
$125,000 to be paid by June 30, 2021.
When the City provides funds to any organization, we prepare a simple Contract For Services agreement that
describes the public services the organization will provide as a result of receiving City funds.
This scholarship fund will guarantee Paducah and McCracken County 8th graders who meet prescribed
standards through their final four years of high school a tuition scholarship for up to sixty (60) hours of college
credit at WKCTC.

Background Information: Since 2011, the PetSafe Bark for Your Park program has donated over $1.5
million for more than 70 dog parks across 40 U.S. states. The contest is committed to creating safe, off-leash
areas for pets and pet owners to enjoy for years to come. This year, PetSafe is awarding prizes totaling
$150,000 to 10 deserving communities with five $25,000 grants dedicated to creating new parks and five
$5,000 grants for park improvements and maintenance.
The Parks Department desires to apply for one of the five $25,000 awards. The department is currently
converting Independence Park into a specified multi-use space, sectioning off an area for dogs. The grant will
go towards installing a water meter, line, and fountain as well as providing improvements to the area to include
sidewalks that are accessible. There is no match requirement.

mobile and portable radios, shoulder microphones and chargers through the 2020 Kentucky Office of
Homeland Security Grant Program. A quote was obtained from Motorola Solutions on Kentucky State
Contract MA 758 1800000118 in the amount of $374,262.28, The KOHS grant covers $314,450 with
$59,812.28 being paid from the Police General Budget. By completing this purchase, all of the police
department's hand-held and in-car radios will be upgraded to the P-25 compliance and will be compatible with
a new 911 radio system. The purchase also lowers the overall cost of the 911 radio system upgrade.

AN ORDINANCE AMENDING CHAPTER 70
OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH
WHEREAS, the City of Paducah wishes to clarify Chapter 70, Section 70-5(6), of the
Code of Ordinance with regard to Rules of Conduct For Recreational Areas;
WHEREAS, Section 70-5(6) of the Paducah Code of Ordinances must be amended to
clarify language regarding dogs in city parks which have been designated as dog parks.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That the City of Paducah, Kentucky hereby amends Section 70-5 of the
Paducah Code of Ordinances by amending the following sections:
Sec. 70-5 Rules of Conduct for recreational areas
The rules of conduct for recreational areas shall be as follows:
(1) Alcohol is not allowed in any city park facility.
(2) Soliciting or sale of material is not allowed in city parks.
(3) Parking is not allowed on grass in city parks.
(4) Do not nail signs to trees.
(5) Obey posted hours of operation.
(6) Dogs must be leashed in all city parks that are not designated dog parks. [and] Dog
droppings must be picked up and disposed of in a waste receptacle when in city parks.
Service animals must be harnessed, leashed, or tethered while in city parks unless these
devices interfere with the service animal's work or the person's disability prevents use of
these devices. Service animals must be under the control of the handler at all times.
(7) Place all trash in waste receptacles.
(8) Overnight stays are not allowed in a city park.
(9) Except as authorized in section 46-91, mechanical games, carnivals, or use of animals
are not authorized in city parks.
(10) If a public address system or other amplification of voice and/or music is used,
sound must not extend beyond the perimeter of the facility being utilized.
(11) Ice-skating is not allowed on Noble Park Lake.
(12) Personal watercraft are not allowed in Noble Park Lake.
(13) Signs or banners cannot be hung from or on towers/front of Noble Park entrance.
(14) Permits for special events and/or nonconforming uses are the jurisdiction of the
Parks Services Director. Organizers are responsible for securing permits for such use
through the Paducah Parks Services office.
(15) The City of Paducah Parks Services may permit for exclusive use shelters, athletic
fields, buildings, facilities and/or specific zones of the park. Other park users may not
interfere with the permitted use.
(16) The Parks Services Director is authorized to temporarily adjust or suspend park rules
as required to serve public safety and/or program logistics.
(17) The Parks Services Director is hereby authorized to adopt additional rules specific to
each facility. Said rules shall be posted in a conspicuous place at the relevant facility and
shall be followed as if fully set forth herein.
SECTION 2. Severability. If any section, paragraph or provision of this Ordinance shall
be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such
section, paragraph or provision shall not affect any of the remaining provisions of this
Ordinance.
SECTION 3. Compliance With Open Meetings Laws. The City Commission hereby
finds and determines that all formal actions relative to the adoption of this Ordinance were taken
in an open meeting of this City Commission, and that all deliberations of this City Commission
and of its committees, if any, which resulted in formal action, were in meetings open to the
public, in full compliance with applicable legal requirements.
SECTION 4. Conflicts. All ordinances, resolutions, orders or parts thereof in conflict
with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the
provisions of this Ordinance shall prevail and be given effect.
SECTION 5. Effective date. This Ordinance shall be read on two separate days and
become effective upon summary publication pursuant to KRS Chapter 424.
