ORDINANCE(S) — ADOPTION
AMEND ALCOHOLIC BEVERAGE ORDINANCE
Commissioner Abraham offered motion, seconded by Commissioner Holland, that the Board of
Commissioners adopt an Ordinance entitled, "AN ORDINANCE AMENDING CHAPTER 6,
SECTIONS 6-2, 6-3, 6-4, 6-5, 6-32, 6-33, 6-34, AND 6-40 AND REPEALING SECTION 6-7
OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY." This
Ordinance is summarized as follows: This Ordinance amends Chapter 6 of the Paducah Code of
Ordinances to conform with recent amendments to KRS Chapters 241 through 244, enacted
pursuant to the passage of House Bill 100, House Bill 183, and House Bill 319 during the 2017
Regular Session of the Kentucky General Assembly. This Ordinance also amends Chapter 6 of
the Paducah Code of Ordinances to permit the sale alcoholic beverages on Sunday for all license
types during the same hours such sales are permitted Monday to Saturday.
Mayor Harless allowed public comments on the proposed alcohol ordinance.
PUBLIC COMMENTS ON PROPOSED ALCOHOL ORDINANCE
Robert Hill and Eddie Singh, owners of package liquor stores, voiced their opposition to the
section of the proposed ordinance that is being amended to allow Quota Retail Package licensees
to sell on Sundays.
MOTION TO AMEND PROPOSED ORDINANCE
Commissioner Rhodes proposed package sales for distilled spirits, wine and malt beverages not
be allowed on Sundays. Mayor Harless seconded the motion.

MARYLAND STREET
Commissioner Rhodes offered motion, seconded by Commissioner Wilson, that the Board of
Commissioners introduce an Ordinance entitled, "AN ORDINANCE EXTENDING THE
BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY INTENT TO ANNEX
CERTAIN PROPERTIES LYING ADJACENT TO THE CORPORATE LIMITS OF THE
CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID
PROPERTIES TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS." This
ordinance is summarized as follows: Approving intent to annex certain tracts of property

contiguous to the present city limits, located at 2909 Lone Oak Road and at 2835 Maryland
Street, containing .9 acres, more or less.
COMMENTS
COMMENTS FROM THE CITY MANAGER
City Manager Pederson wanted to recognize and commend all city employees who are involved
with preparations for the BBQ on the River event and other city events. He also asked City
Engineer Rick Murphy to give an update on the state of preparedness for the BBQ event since it
is such a big undertaking for the city. The City provides manpower and services in excess of
$100,000 in-kind value every year. This is the 23RD year for the event.
COMMENTS FROM THE BOARD OF COMMISSIONERS
Commissioner Abraham commented on the topic of the removal of the General Tilghman statue
that was discussed at the September 12'h commission meeting. One of the objections he heard
that night was the City spending public funds on the maintenance of the statue. He wanted
clarification. He started researching and found the City does maintain the park but has not spent
any funds on the maintenance of the statue. While researching, he did find the City has
maintained the Reverend Martin Luther King Jr. memorial since 2000. It is a piece of private
property located on Martin Luther King Jr Drive, which is owned by the McCracken County
Branch of the NAACP (National Association of Colored People). While he does NOT object to
the City maintaining this property, he just wanted to let the public know maintenance costs
(lighting & mowing) over the years amount to approximately $37,000.
He has also been thinking a lot about the question the Mayor posed at the end of the September
12"meeting, "What does racism look like in 2017?" His comments led into a discussion with
the Board about racial disparity and hard conversations that need to be held regarding racism
The local Race Unity Group is having these hard conversations.
COMMENTS FROM THE AUDIENCE
• Michael Swinford gave comments on the Veteran's Day Parade resolution adopted in May.
• Steve Hamed spoke about his opposition to any change or removal of the General Lloyd
Tilghman statue.

Background Information:
The Noble Park Tennis Courts are the only public tennis courts in the City of Paducah. They
are well used and well worn. Over the years large cracks have developed in the surface
making play difficult.
Tuesday October 3, 2017 bids were advertised to be opened. Central Paving of Paducah was
the only bid received. However, the base bid of Central Paving was $10,700 below that of the
engineers estimate. Additionally, it is recommended that we take a deduction for Alternate
91 of $3,811.49 to allow for the reuse of the portion of the fence that was installed earlier this
year after storm damage.
Staff recommends approval of the bid and Alternate 41 by Central Paving for the project
totaling $177,009.06.
Bids for the new lighting of the tennis courts will be coming forth after completion of the
surface work.

A MUNICIPAL ORDER ACCEPTING THE BID OF CENTRAL PAVING
COMPANY OF PADUCAH, INC., UTILIZING THE FIRST DEDUCTIVE ALTERNATIVE
FOR THE NOBLE PARK TENNIS COURT RECONSTRUCTION PROJECT. AND
AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME
WHEREAS, on October 3, 2017, the City received a sealed written bid from
Central Paving Company of Paducah Inc., for the Noble Park Tennis Court Reconstruction
Project; and
WHEREAS, the base bid submitted was in the amount of $180,820.55 with a
deductive alternate #1 in the amount of $3,811.49 if the City chooses to reuse the portion of the
fence that was installed earlier this year after storm damage; and
WHEREAS, the base bid of Central Paving is $10,700 below that of the
engineer's estimate; and
WHEREAS, the City wishes to accept the bid with Deductive Alternate # 1 and
proceed with execution of a contract for the reconstruction project.
NOW, THEREFORE, BE IT ORDERED BY THE BOARD OF
COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah accepts the bid of Central Paving
Company of Paducah, Inc., utilizing the first deductive alternative in the total amount of
$177,009.06 for the Noble Park Tennis Court Reconstruction project, said bid being in
substantial compliance with the bid specifications and advertisement for bids, and as contained in
the bid of Central Paving Company of Paducah, Inc., of October 3, 2017.
SECTION 2. That the Mayor is hereby authorized to execute a contract with
Central Paving Company of Paducah, Inc., for the Noble Park Tennis Court Reconstruction
Project, as set out in Section 1 above, according to the specifications, bid proposal and all
contract documents heretofore approved and incorporated in the bid.

After review of the single bid received on October 3, 2017 from Central Paving Company, it is
the recommendation of Bacon Farmer Workman that the low responsive base bid and deductive
alternate bid #1 totaling One hundred seventy-seven thousand, nine dollars and six cents
($177,009.06) be accepted by the City for the construction of the above referenced project.
Although only one bid was received the bid was under the Engineer's estimate and all associated
bid submittal items were found in compliance with the project manual.

AGREEMENT FOR
NOBLE PARK TENNIS COURTS RENOVATION
THIS AGREEMENT, made this day of , 2017 by and between the CITY OF
PADUCAH, hereinafter called the OWNER, and , hereinafter called the
CONTRACTOR, for the consideration hereinafter named, agree as follows:
ARTICLE 1. SCOPE OF WORK
The Contractor agrees to furnish all the necessary labor, materials, equipment, tools and services
necessary for the construction of the Noble Park Tennis courts Renovation. All Work shall be in
accordance with this Agreement, the Plans, Specifications and anyAddendum(s) issued.
Throughout the performance of this Contract, the Engineering -Public Works Department of the
City of Paducah shall, in all respects, be acting as both Engineer and agent for the Owner, City of
Paducah. All work done by the Contractor shall be completed under the general supervision of the
Engineer.
ARTICLE 2. TIME FOR COMPLETION AND LIQUIDATED DAMAGES
The Contractor hereby agrees to commence work under this contract on or before a date to be
specified in the Notice to Proceed and to fully complete the project Ninety (90) consecutive calendar
days thereafter.
Failure of the Contractor to complete the work in the time specified above plus any extensions
allowed in accordance with the General Conditions shall result in the assessment of liquidated damages
for the delay (not as a penalty). Liquidated damages shall be in the amount of Two Hundred and Fifty
Dollars ($250.00) per consecutive calendar day for failure to meet the final completion date and shall be
withheld from final payment.
ARTICLE 3. THE CONTRACT SUM
The Owner agrees to pay the Contractor for the performance of the Contract, subject to additions
and deductions provided therein:

constitute full compensation for the work and services authorized herein.
ARTICLE 4. PROGRESS PAYMENTS
The Contractor may submit each month, and no more than once a month, a Request for Payment
for work completed in accordance with the Specifications. The Owner will make partial payments on or
about thirty (30) days after submission of a properly completed invoice and approval of the completed
work. At the Engineer's discretion, a ten percent (10%) retainage may be held until final completion and
acceptance of the work.
ARTICLE 5. ACCEPTANCE AND FINAL PAYMENT
Final payment shall be due sixty, (60) days after substantial completion of the work, provided the
work will then be fully completed and the Contract fully performed in accordance with the specifications.

ARTICLE 6. GOVERNING LAW
The Parties agree that this Agreement and any legal actions concerning its validity, interpretation
and performance shall be governed by the laws of the Commonwealth of Kentucky. The parties further
agree that the venue for any legal proceeding relating to this Agreement shall exclusively be in McCracken
County, Kentucky.
ARTICLE 7. THE CONTRACT DOCUMENTS
The Plans, Specifications and any addendum that may have been issued are fully a part of this
Contract as if thereto attached or herein repeated.

In compliance with your Invitation for Bid, Bidder hereby proposes to furnish all the necessary labor,
materials, equipment, tools and services necessary for the construction of the Noble Park Tennis Court
Renovation in accordance with the plans, specifications and other contract documents prepared by the
City Engineering -Public Works Department, at the prices stated below.
By submission of this Bid, each Bidder certifies that this Bid has been arrived at independently, without
consultation, communication or agreement as to any matter relating to this Bid with any other Bidder or
with any other competitor.
The Bidder further understands the quantities shown herein are estimates only and the Owner reserves
the unlimited right to add to or delete from same at its discretion. In case of a discrepancy In the
extension of a bid price, the unit pri a shall govern over the total price for all items.

After reasonable consideration of all bids received, a Notice of Award will be given to the Responsible
Bidder who submits the lowest responsive bid in accordance with the specifications. The
responsible Bidder shall have the capability in all respects to perform fully the contracts requirements,
and the moral integrity and reliability of which to assure good faith performance. The responsive Bidder
shall submit a bid that conforms in all material respects to the specifications without any deviations of the
invitation for bids.
If Notice of Award is given to the Bidder within Sixty (60) days after the time of receipt of Bids, the Bidder
agrees to execute and deliver a Contract Agreement in the prescribed form and furnish the required bonds
and insurance within ten (10) days after the Contract is presented for signature.
Bidder hereby agrees to commence work under this contract on or before a date to be specified in the
Notice to Proceed and to fully complete the project within One Hundred Twenty (120) consecutive
calendar days thereafter. Bidder further agrees to pay as liquidated damages, the sum of Two Hundred
and Fifty Dollars ($250.00) for each consecutive calendar day thereafter until project completion as
provided in accordance with Specifications. Payments for Work Completed will be made in accordance
with the Specifications.
