At a Regular Meeting of the Board of Commissioners, held on I'Ziesday, September 20, 2016, at
5:30 p.m., in the Commission Chambers of City Hall located at 300 South 5th Street, Mayor
Kaler presided, and upon call of the roll by the City Clerk, the following answered to their
names: Commissioners Gault, Rhodes, Wilson and Mayor Kaler-(4). Commissioner Abraham
arrived at approximately 5:42. p.m. (1).
PROCLAMATION
Mayor Kaler presented a proclamation to Mindy Smith, President of the Business & Professional

APPROVE DUE DATE EXTENSION OF GPEDC LOANS TO JUNE 30, 2020
Commissioner Abraham offered motion, seconded by Commissioner Gault, that the Board of
Commissioners adopt an Ordinance entitled, "AN ORDNANCE OF THE CITY OF
PADUCAH, KENTUCKY, APPROVING A PROMISSORY NOTE EXTENSION
AGREEMENT AND ADDENDUM TO REAL ESTATE MORTGAGE AMONG THE CITY
OF PADUCAH, KENTUCKY, THE COUNTY OF MCCRACKEN, KENTUCKY AND THE
GREATER PADUCAH ECONOMIC DEVELOPMENT COUNCIL WITH RESPECT TO A
PUBLIC PROJECT GENERALLY KNOWN AS "RIVERPORT WEST;" AND
AUTHORIZING THE EXECUTION OF SAME." This ordinance is summarized as follows:
This Ordinance authorizes the City of Paducah, Kentucky (the "City") to approve a Promissory Note
Extension Agreement and Addendum to Real Estate Mortgage ("Agreement") by and between the
City of Paducah, Kentucky (the "City"), the County of McCracken, Kentucky (`County'), and the
Greater Paducah Economic Development Council ("GPEDC"). Pursuant to the Agreement the City
and the County agree to extend the maturity date of the indebtednesses due and owing by GPEDC
unto the City and County until June 30, 2020, which indebtednesses are evidences by promissory
notes dated September 18, 2007 in the original principal amounts of $600,000.00 and promissory
notes dated December 19, 2008, and are secured by real estate mortgages. The Ordinance
approves the form of the Agreement presented to the Board of Commissioners of the City, with such
changes therein as shall not be adverse to the City and may be approved by the Mayor and City
Clerk.

ACCEPT BID FOR NOBLE PARK TENNIS SHELTER/RESTROOM FACILITY
Commissioner Gault offered motion, seconded by Commissioner Abraham, that the Board of
Commissioners adopt an Ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF Nl.
P. LAWSON CONSTRUCTION, LLC FOR THE NOBLE PARK TENNIS COURTS
RESTROOM FACILITY CONSTRUCTION PROJECT, AND AUTHORIZING THE MAYOR
TO EXECUTE A CONTRACT FOR SUCH CONSTRUCTION AND CHANGE ORDER 1 TO
SUCH CONTRACT ALLOWING THE CITY TO MAKE DIRECT PURCHASE OF THE
MODULAR RESTROOM FACILITY." This ordinance is summarized as follows: This
Ordinance authorizes the Mayor to enter into contract with M. P. Lawson Construction, LLC, a
Kentucky limited liability Company, in the amount of $152,936.00 for the Noble Park Tennis
Courts Restroom Facility Construction Project and subsequently authorizes the Mayor to enter
into Change Order 1 to said contract reducing the contract price due to Contractor to the amount
of $61,250.06. Further the ordinance authorizes the Director of Parks Services to make a direct
purchase of the modular restroom facility from Hunter Knepshield Company for $86,637.00.

ACCEPT BID FOR FURNITURE PURCHASE FOR POLICE DEPARTMENT ANNEX
Commissioner Rhodes offered motion, seconded by Commissioner Wilson, that the Board of
Commissioners adopt an Ordinance entitled, "AN ORDINANCE ACCEPTING THE
PROPOSAL OF WILSON OFFICE SOLUTIONS FOR THE PURCHASE OF FURNITURE
FOR THE POLICE DEPARTMENT ANNEX LOCATED AT 1410 BROADWAY AND
AUTHORIZES THE MAYOR TO EXECUTE A CONTRACT FOR SAME.` This ordinance is
summarized as follows: That the City of Paducah accepts the bid of Wilson Office Solutions in
an amount not to exceed $42,127,13, for the purchase of furniture for the Police Department
Annex located at 1410 Broadway, and authorizes the Mayor to execute a contract for same.

ACCEPTING A 2015-2016 ASSISTANCE TO FIREFIGHTERS MATCHING GRANT FROM
THE KENTUCKY OFFICE OF HOMELAND SECURITY, FEDERAL EMERGENCY
MANAGEMENT AGENCY FOR THE PADUCAH FIRE DEPARTMENT, AND
AUTHORIZNG THE MAYOR TO EXECUTE ANY AND ALL AGREEMENTS RELATING
TO SAME." This ordinance is summarized as follows: That the City of Paducah hereby
accepts grant funds in the amount of $87,455 through the Kentucky Office of Homeland
Security, Federal Emergency Management Agency for a 2015/2016 Assistance to Firefighters
Matching Grant Award for the Fire Ground Survival Program sponsored by the Paducah Fire
Department, Further, the Mayor is hereby authorized to execute a Grant Agreement and all
documents relating to same.

Commissioner Abraham offered motion, seconded by Commissioner Gault, that the Board of
Commissioners introduce an Ordinance entitled, "AN ORDINANCE ACCEPTING THE BID
OF MCBRIDE MACK, INC., FOR SALE TO THE CITY OF ONE, NEW 2017 FRONT-
LOADING REFUSE COLLECTION CHASSIS AND BODY FOR USE BY THE SOLID
WASTE COLLECTION SYSTEM, AND AUTHORIZING THE MAYOR TO EXECUTE A
CONTRACT FOR SAME." This ordinance is summarized as follows: The City of Paducah
accepts the bid of NIcBride Mack, Inc., in the amount of $233,119.00, for sale to the City of one,
new 2017 front -loading refuse collection chassis and body, and avihorizes the Mayor to execute
a contract for same.
FIRE STATION 92 PLUMBING RENOVATION PROJECT
Commissioner Gault offered motion, seconded by Commissioner Abraham, that the Board of
Commissioners introduce an Ordinance entitled, "AN ORDINANCE ACCEPTING THE BID
OF M. P. LAWSON CONSTRUCTION, LLC FOR PLUMBING RENOVATION FOR FIRE
STATION 92, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR
SAME." This ordinance is summarized as follows: The City of Paducah accepts the bid of M.
P. Lawson Construction, LLC in the amount of $74,787.00 for plumbing renovations to Fire
Station 92, located at 3000 Wayne Sullivan Drive, and authorizes the Mayor to execute a
contract for same.
AMEND DOG ORDINANCE
Commissioner Rhodes offered motion, seconded by Commissioner Gault, that the Board of
Commissioners introduce an Ordinance entitled, "AN ORDINANCE AMENDING SECTION
14-32, DOGS PERMITTED AT SPECIAL COMMUNITY EVENTS; RESTRICTIONS; OF
CHAPTER 14, ANIMALS, OF THE CODE OF ORDINANCES OF THE CITY OF
PADUCAH, KENTUCKY." This Ordinance is summarized as fol.Jows: The City hereby
amends Section 14-32, Dogs Permitted at Special Community Events; Restrictions, of Chapter
14, Animals, of the Paducah Code of Ordinances to eliminate the requirement that dogs be
restrained by an open ended -muzzle at special community events.

Background Information: The Paducah Fire Department proposes to submit a grant application to the
Department of Homeland Security, Federal Emergency Management Agency (FEMA). The primary goal
of the Assistance to Firefighter Grant Program (AFG) is to meet the firefighting and emergency
response needs of fire departments and emergency service organizations.
The Paducah Fire Department has been awarded a 2015-2016 AFG Application is for the Fire Ground
Survival program to ensure that training for MAYDAY prevention and MAYDAY operations are consistent
between all fire fighters, company officers, and chief officers. Fire figh`ers must be trained to perform
potentially life-saving actions if they become lost, disoriented, injured, low on air, or trapped. These training
exercises must be consistent throughout the fire service. Funded by the IAFF and assisted by a grant from
the U.S. Department of Homeland Security through the Assistance to Firefighters Grant Program, our
comprehensive Fire Ground Survival training program applies the lessons learned from Fire Fighter Fatality
Investigations conducted by the National Institute for Occupational Safely and Health (NIOSH) and has
been developed by a committee of subject matter experts from the International Association of Fire
Fighters, the international Association of Fire chiefs and NIOSH.
This program is suitable for all rank and experience levels. The Fire Ground Survival course is a
comprehensive curriculum developed using near misses, close calls, and fre fighter fatalities to address
the critical elements of fire ground survival. Information from NIST, NIOSH, IAFF, IAFC, UL, USFA, NFPA
and the military was used to develop the five part curriculum consisting of- 1.) Mayday Prevention, 2.)
Being Ready for the Mayday, 3.) Self -Survival Procedures, 4.) Self-SuRNal Skills, and 5,) Fire Fighter
Expectations of Command During a Mayday.
A fire department may be a host site for up to 30 candidates in the train -the -trainer at a fixed fee of
$77,000. As part of this fee, the IAFF-Certified FGS Instructor will be reg stered with the IAFF and will
receive all updated training materials and continued information regarding the FGS Program. Also as part
of this fee, the IAFF will provide two sets of durable, fabricated props for the Upper Floor Egress,
Disentanglement, and Reduced/Low Profile Wall Breach on a mobile trailer. Durable signage for all props
and training stations will also be provided, These props and signage will remain the property of the host.
The IAFF will provide ail the required training manuals and resource mate[Zas. Each student for the IAFF-
Certified FGS Instructor Program w0i be required to have these teaching aids

Also, the grant will cover overtime; as well as, the backfield overtime caused by training, for career
departments. The cost for 20 career firefighters is estimated to cost $19,200.
The total project cost is $96,200. The AFG grant award is for $87,455 and there is match requirement of
$8,745. Matching funds will be provided by the Fire DepartmentDper ion Budget.

Background Information:
On September 15, 2016, sealed written bids were opened for the Plumbing Renovation at
Paducah Fire Station #2, Two responsive bids were received; with M. P. Lawson
Construction, LLC submitting the lowest responsive bid of $74,787.00.
At this time, the condition of the restroom facilities at Fire Station 42 have deteriorated and
are in dire need of reconstruction and repair. This Project will improve the existing restroom
facility at Fire Station #2 by reconstructing and replacing the restroom walls, ceilings,
flooring, doors, plumbing and miscellaneous related items.

AN ORDINANCE AMENDING SECTION 14-32, DOGS PERMITTED AT
SPECIAL COMMUNITY EVENTS; RESTRICTIONS, OF CHAPTER 14, ANIMALS, OF
THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCA.K, KENTUCKY:
SECTION 1. That Section 14-32, Dogs Permitted A Special Community Events;
Restrictions, of Chapter 14, Animals, of the Code of Ordinances of the City of Paducah,
Kentucky, is hereby amended to read as follows:
"Sec. 14-32. - Dogs permitted at special community events; restrictions,
(a) No person shall bring a dog into an area designated for special community
events during the times such events are occurring unless the dog is:
(1) Licensed by McCracken County Animal Control or by any other state
or county.
(2) Restrained by a leash or other lead that is no longer than three Feet: and
(b) Special community events include, but are not limited to, the Paducah
Summer Festival, Barbecue on the River, Parades; Saturday Night After Dinner
Program, and other similar events."
SECTION 2. That if any section, paragraph or provision of this Ordinance shall
be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of
such section, paragraph or provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this Ordinance to make each and every section,
paragraph, an provision hereof separable from all other sections, paragraphs and provisions.
SECTION 3. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424,

Background Information:
Real estate and personal property tax levies for the City's General Fund and Paducah
Junior College (PJC) as well as another (non -City) tax jurisdiction, the Paducah
Independent School District, are proposed to be set as per the attached ordinance. Please
refer to exhibits 1-3 for a history of the ad valorem tax levies for real estate (exhibit I),
personal (exhibit 2) & inventory (exhibit 3).
The City's General Fund real estate tax levy is proposed to be $25.5 cents per S 100 AV,
The proposed FY2017 rate is 56% of what the rate was in F)' 1995, when the City starting
making a conscious effort to lower real estate tax rates (see elchibit 1).
The City's General Fund personal tax levy is proposed to be $39 cents per $100 AV.
The proposed FY2017 rate is 23% less than the FY 1995 rate (see exhibit 2).
The City and PJC eliminated inventory taxes (see exhibit 3) on businesses in order to
encourage business growth in Paducah many years ago. As you may recall, the City's
inventory rate was phased out over a four-year period, 1998 through 2002, and fully
eliminated in FY2003. The inventory tax revenue would have been nearly $1.0 million in
FY2017, if it were still in place today.
Staff proposes the City's tax levy be set at 25.5 cents per S100 assessed value (AV), the
same rate as last year (FY2016). The FY2017 compensating rate is 25.4 cents per $100
AV and Kentucky Revised Statutes (KRS) permits a city to adjust the compensating rate
upward by not more than 4%, in this case to 26.4 cents. The City of Paducah is
proposing to take an amount less than the 4% allowed by KRS, as it has many times in
the past (see chart A).
From FY2001 to FY2017, the City of Paducah has dropped its real estate tax levy by 4.5
cents, while the School District tax levy increased 20.2 cents (see chart B). The Paducah
Independent School. District real estate levy will decrease 0.1 cents to 79 and 9110
cents/S 100 AV. While Paducah's levy was 25.5 cents last year, in a survey of 18

Kentucky cities last fall, it was established that Paducah's rate was less than the group's
average ($.2749). The historical average (FY2012-FY2016) of property tax rates for the
cities surveyed leveled off over last year (see chart C"). Last year, Paducah's rate was
nearly 2 cents below the group's average of 27.5 cents.
The property tax levy ordinance will be introduced on September 27, 2016 with the
second and final reading on October 4, 2016. Since the City's proposed tax levy is
greater than the `compensating rate' of 25.4 cents per $100 AV, a public hearing is
required; a public hearing is scheduled for September 27, 2016.

BE IT ORDAINED BY THE CITY OF PADUCAH, UNTUCKY:
SECTION 1. There is hereby levied for the period from July 1, 2016, through
June 30, 2017, upon all taxable real property within the City of Paducah, Kentucky, subject to
taxation for municipal purposes, an ad valorem tax of twenty five and 5110 cents (5.255) upon
each one hundred dollars ($100.00) assessed valuation of said property, pursuant to Section 157
of the State Constitution, to defray the cost of maintaining and admin istering the government of
the City of Paducah, Kentucky, for said period, exclusive of the levies hereinafter mentioned and
defined, and the proceeds of said tax levy shall be paid into the General fund of the City.
SECTION 2. There is hereby levied for the period from July 1, 2016, through
June 30, 2017, upon all taxable personal property including motor vd-ucles and watercraft,
except for inventory, within the City of Paducah, Kentucky, subject to taxation for municipal
purposes, an ad valorem tax of thirty-nine cents ($0.390) upon each orie hundred dollars
(S 100.00) assessed valuation of said property, pursuant to Section 157 of the State Constitution,
to defray the cost of maintaining and administering the government of the City of Paducah,
Kentucky, for said period, exclusive of levies hereinafter mentioned and defined, and the
proceeds of said tax levy shall be paid into the General Fund of the City.
SECTION 3. All taxes levied by Section 1 and 2 of fiis ordinance are necessary
and required in order to provide revenue to meet the requirements oflhebudget ordinance
adopted by the Board of Commissioners, and the proceeds of such tas levies and all other
revenue of the City not specifically allocated to other purposes shall be deposited into the
General Fund of the City to be expended as provided in the budget ordinance for the period from
July 1, 2016, through June 30, 2017,
SECTION 4. There is hereby further levied an ad valorem tax of one and 7/10
cents ($0.017) on each one hundred dollars (S I00.00) of assessed valLation of all real property
subject to taxation for municipal purposes in said City for the period from July 1, 2016, through
June 30, 2017, for the purpose of aiding, assisting and maintaining Paducah Junior College,
which tax shall be and the same is hereby declared to be a tax for municipal purposes.
SECTION 5. There is hereby further levied an ad valorem tax of one and 7/10
cents (50.017) on each one hundred dollars (5100.00) of assessed valuation of all personal
property subject to taxation, except for inventory, for municipal purposes in said City for the
period from July 1, 2016, through June 30, 2017, for the purpose of aiding, assisting and
maintaining Paducah Junior College, which tax shall be and the same is hereby declared to be a

SECTION 6. There is hereby further levied an ad valcrem tax of three and 1110
cents (SO. 031) on each one hundred dollars ($100.00) of assessed valuation of all motor vehicles
and watercraft property subject to taxation for municipal purposes in said City for the period

Paducah Junior College, which tax shall be and the same is hereby declared to be a tax for
municipal purposes.
SECTION 7. The Board of Education of the City of Paducah, Kentucky, pursuant
to the authority vested in it under its charter and under the laws of the Commonwealth of
Kentucky has adopted a resolution and budget levying an ad valorem tax on all real property in
said City subject to taxation for school purposes. Pursuant to said resolution, budget and levy the
following taxes for the period from July 1, 2016, through June 30, 2017, an ad valorem tax of
seventy nine and 9/10 cents (S0.799) on each one hundred dollars ($100.00) assessed valuation
of all real property subject to taxation for school purposes in the City of Paducah, Kentucky, for
the support and maintenance of the public schools of said City shall be collected by the City for
the Board of Education.
SECTION 8. The Board of Education of the City of Paducah, Kentucky, pursuant

Background Information: Arts Engagement in American Communities (AEAC) supports arts projects in
all artistic disciplines, extending the National Endowment for the Arts' reach to communities across the
United States. These grants will engage the public in diverse and excellent art in geographic areas
underrepresented in our grant making portfolio. Grants are available for professional arts programming,
including the presentation of artists or artworks, marketing and promotional activities, educational
programs, and organizational planning. All AEAC grants are for $10,000, and require a minimum $10,000
match with non-federal support.
On April 5, 2016, the Board of Commissioners approved the submitted of the AEAC application through
municipal order 1899.
The Paducah Planning Department has been awarded $10,000 from the AEAC program for the
installation of a branded wayfinding system. Installation of signs will be strategically placed at key
locations throughout downtown and the lower Town Arts District. Additional signage is also needed for
strategically directing visitors to key cultural and artistic attractions, The City will be providing a
$10,000 cash matcor the project. The grant period is from October 1, 2016 through September 30,
2017. All project activities must be complete within that time period.

Background Information:
The intent of this agenda item is to adopt an ordinance establishing an assessment and
reassessment moratorium for the W.B. Sanders Apartments and the Jackson House. KRS 99.595
through 99.605 and KRS 132.452 permit local governments to establish a property assessment
and reassessment moratorium for qualifying properties.
The Department of Planning proposes to take advantage of these statutes to encourage the repair,
rehabilitation, restoration or stabilization of these two properties, located at 300 and 301 South
91" Street, respectively.
The property tax moratorium defers the value of improvements to an existing building from the
taxable assessment of the property for five years, rather than being raised to reflect a higher
assessment resulting from improvements made to the property. The proposed moratorium does
not affect any other property taxes such as McCracken County taxes, school, library, etc.
Both properties are eligible for the proposed moratorium pursuant to KRS 99.595 (3), The W.B.
Sanders apartments must have a minimum investment of $3.5 million and the Jackson House a
minimum investment of $11 million. These numbers were gathered from Beacon Property
Management, who is contemplating major improvements to both buildings.

AND REASSESSMENT MORATORIUM FOR CITY OF
PADUCAH TAXES AND AUTHORIZING THE DIRECTOR OF
PLANNING TO ADMINISTER THE MORATORIUM
WHEREAS. KRS, 99.595 through 99.605 and KRS 132.452 permit local governments to
establish property assessment and reassessment moratoriums for qualifying properties; and
WHEREAS, the City of Paducah wishes to take advantage of the provisions of these laws
to encourage the repair, rehabilitation, restoration or stabilization of existing real property in the
City of Paducah, Kentucky; and
WHEREAS, Western Kentucky Union Labor Senior Citizens Housing Corporation, a
Kentucky not -For-profit corporation, ("Owner") is the current occupant/owner of the real
property and improvements located at 300 and 301 South 9th Street, in Paducah, McCracken
County, Kentucky 42003, upon which is located the existing residential buildings generally
known as the Jackson House Apartments and the W.B. Sanders ketirement Center; and
WHEREAS, a request has been made by the Owner for the granting of a property
assessment or reassessment moratorium for the real property and existing residential buildings of
Owner, generally known as the Jackson House Apartments and the W.B. Sanders Retirement
Center located at 300 and 301 South 91h Street, Paducah, McCracken County, Kentucky
(collectively, the `Properties").
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1: The Properties are eligible for property assessment or reassessment moratorium
pursuant to KRS 99.595(3) as existing residential buildings, having been in existence for at least
twenty-five (25) years and are being used to provide independent: living facilities for one (1) or
more persons; and moratoriums shall be granted when and provided, however, each of the
following conditions are fully satisfied by the Owner:
(i) The costs of improvements to the existing residential building, generally known
as the W.B. Sanders Retirement Center, including materials and lal}or, must exceed $3,500,000.
(ii) The cost of improvements to the existing residential building, generally known as
the Jackson House Apartments, including materials and labor, must exceed $11,000,000.
(iii) The rehabilitated portion of the existing residential buildings must comply with
all applicable building codes.
(iv) All required permits (i.e. zoning, building, etc.) must have been obtained, the real
property upon which the existing residential buildings sit must be free of any liens held by the
City of Paducah, and all property taxes and any and all other governmental levies, assessments or
taxes of every kind and nature whatsoever, which are assessed, levied, imposed upon, or would
become due and payable out of or with respect to the real property upon which the existing
residential buildings sit must be paid, including without limitation business license fees.
(v) The Owner shall file an application with the administering agency as follows:
(1) The application shall be on a form prescribed by the Department of Revenue and
shall be filed in the manner prescribed by the Department of Planning,
(2) The application shall be filed with the administering agency thirty (30) days
before commencing the restoration, repair, rehabilitation, or stabilization.
(3) The application shall contain the following:
(a) A general description of the Properties;
(b) A general description of the proposed use of the Properties;
(c) The general nature and extent of restoration, repair, rehabilitation or
stabilization to be undertaken and cost estimates based on bids submitted to
the applicant;
(d) A time schedule for undertaking and completing the project;
(vi) The Owner shall have completed the improvements within two (2) years of
approval of the application for property assessment or reassessment moratoriums by the
administering agency, unless granted an extension in writing by the Department of Planning and
the Paducah City Commission, In no case shall the application be extended beyond two (2)
additional years. This provision shall not preclude normal reassessment of the Properties.
SECTION 2: The administering agency for this moratorium shall be the City of Paducah
Department of Planning.
SECTION 3: This moratorium shall be for a period of five (5) years, and shall become effective
on the assessment date next following the issuance of the moratorium certificate by the City of
Paducah Department of Planning.
SECTION 4: The Property Valuation Administrator (PVA) shall assess or reassess the
Properties within thirty (30) days of the approval of the application for property assessment or
reassessment moratoriums by the administering agency. This assessment shall be the value for
which the City of Paducah taxes are to be levied for five (5) years after the moratorium
certificate has been issued.
SECTION S: Any application not acted upon by the applicant shall become void two (2) years
from the date of application and shall be purged from the files of the PVA and the Department of
Planning.
SECTION 6: The Owner shall notify the Department of Planning when the project is complete,
and the Department of Planning shall then conduct an on-site inspection of the Properties for
purposes of verifying that the improvements described in the application have been completed.
Only after the project is complete and the improvements verified shall the moratorium certificate
be issued by Department of Planning.
SECTION 7: An assessment or reassessment moratorium certificate may be transferred or
assigned by the holder of the certificate to a new owner or lessee of the Properties.
SECTION S: At the end of the moratorium period, whether by expiration, cancellation or
revocation, the Department of Planning shall send the Owner and the PVA a letter advising of
the end of the moratorium and the reassessment of the Properties. On the assessment date next
following the expiration, cancellation or revocation of an assessment or reassessment
moratorium, the Properties shall be assessed on the basis of its fall fair cash value.
SECTION 9: The Properties may be eligible for a subsequent moratorium certification
provided that reapplication be made no sooner than three (3) years following the expiration of
the original moratorium or any subsequent moratoriums.
SECTION 10: Definitions for interpreting this ordinance shall be those outlined in KRS
Chapter 99 relating to property assessment and reassessment moratoriums.
SECTION 11. Severability. If any section, paragraph or provision of this Ordinance shall be
held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such
section, paragraph or provision shall not affect any of the remaining provisions of this
Ordinance.
SECTION 12. Compliance With Open Meetings Laws. The City Commission hereby finds and
determines that all formal actions relative to the adoption of this Ordinance were taken in an
open meeting of this City Commission, and that all deliberations of this City Commission and of
its committees, if any, which resulted in formal action, were in meetings open to the public, in
full compliance with applicable legal requirements.
SECTION 13. Conflicts. All ordinances, resolutions, orders or parts thereof in conflict with the
provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the
provisions of this Ordinance shall prevail and be given effect.
SECTION 14, Effective Date, This Ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.

Background Information:
Recently, my office received a question regarding ownership l'a certain 20' strip private
roadway adjacent to the Floodwall property near John Puryear Drive. Previously, the 20' by
400' strip of property appeared to be an easement acquired from the Paducah and Illinois
Railroad Company. However, after researching the Floodwall records, the ownership
became contradictory.
During 1938, the City of Paducah was in the process of acquiring property in the vicinity of
Husbands Road for the "C" portion of the proposed Floodwall. On January 26, 1939, the
City acquired an easement over a 400' portion of a 20' strip olFla.nd owned by the Paducah
and Illinois Railroad Company. This 20' property was previously acquired by the P&I RR in
1913 to be used as a private right of way for a road, The original Floodwall maps indicated
that P&I RR owned the property.
However, within the Floodwall records a title search dated 1938 was found which indicated a
conveyance deed granted prior to the conveyance to the P&I RR, was not recorded; and
therefore, P&I RR did not have full rights to the property. Consequently, on January 26,
1939, (the same recording date of the P&I RR deed), J, Lawrence Jones and his wife Clara
Jones conveyed a 20' x 400' strip of property to the City, Furthcr, recent case law in
Kentucky calls into question the ownership rights of railroads upon abandonment of railway
lines. P&I RR railway lines affecting the 20' strip of land have been abandoned.
Upon corporate consultation, it is the opinion of Lisa Emmons, with Denton Law Firm; that
the City holds some ownership interest in the 20" strip of land and not only an easement from
P&I RR.
Recently; Lots of Wheels, LLC acquired the adjacent property along John Purycar Drive as
Nvell as whatever interest P&I RR had in and to the 20' strip laird and is now requesting that
the City consider quitclaiming and releasing a remnant portion ofthe 20' strip by
approximately 30' that is located outside the Floodwall right of way. The Floodwall does
not require this area outside of the Floodwall. Additionally, the Floodwall does not require
the 20' strip by approximately 235' portion on the opposite side of the Floodwall with is
adjacent to property owned by MAFGAH Properties & Developrnent, Inc,

Therefore, Commission approval is requested in order to quitclaim any ownership interest
that the City may have to the two 20' strips of remnant property that are no longer required
for )~loodwall purposes to the adjacent property owners; and to authorize the preparation and
execution of a plat and the two quitclaims in order to finalize the quitclaim action to the two
adjacent property owners.
