Background Information:
This action would declare 1209 Bell Avenue surplus property owned by the City of
Paducah and authorize the transfer of the vacant lot to the adjacent property owner
Glenda Sharp. She submitted an offer to purchase the property for $1000. She would use
the property expand her yard and in the future plans to construct a two car garage. The
property has been advertised in the Paducah Sun on more than one occasion the last being
on Sunday, December 16, 2012. No bids were received. In addition to the advertising
and the placing of signs on the lot, the property is listed on the City's website. The
surplus property owned by the City has been the subject of media coverage in the past.
Sec. 2-654 (4) c. of the Paducah Code of Ordinances allows the city to enter into
competitive negotiations once an invitation to bid has been made in accordance with
section 2-645 (a through g) and no bids are received from a responsive and responsible
bidder. The conditions of the ordinance have been satisfied; therefore, staff recommends
that the Commission declare the property surplus and transfer to Mrs. Glenda Sharp for
her offer of $1000.

2. Its intended use at the time of acquisition:
This lot was acquired by the City of Paducah on by conunissioners deed recorded in
Deed Book 1083 Page 287 in January of 2006. The City clid not have a specific use for
the property at the time of the acquisition.
3. The reason why it is in the best interest of the City to dispose of the
item:
Several months ago staff compiled a list of properties that the City had acquired over the
years through various means. This lot is on the list of properties staff deemed as surplus.
The City of Paducah has owned and maintained the property since 2006. It is in the best
interest of the City of Paducah to transfer that property to a responsible owner that will
take over and maintain the property and possibly develop in the future.
4. The method of disposition to be used:
The property will be sold to adjacent property owner Glenda Sharp. She submitted a bid
and offers to pay $1000 for the property. She will use the property to expand her yard and
in the future plans to put a two car garage on the lot.
Therefore, staff recommendation is that it is in the best interest of the city to declare this
property surplus and approve the transfer of this property to Mrs. Glenda Sharp.

Background Information: The Kentucky Office of Highway Safety, a division of the Kentucky
Transportation Cabinet, has a competitive, discretionary grant program that offers reimbursements to
police agencies for the salaries and benefits of peace officers working overtime hours and engaged in
specific traffic enforcement activities. The program also offers reimbursements for specific traffic
enforcement related supplies and equipment. This past year the police department received $36,200 for
overtime traffic enforcement activities.
The Paducah Police Department desires to submit an application for the 2013/2014 year in the amount up
to $40,000 to continue funding overtime traffic enforcement activities and $10,000 for related
equipment for the total of $50,000. This program will reimburse 100 % of approved personnel and
equipment expenses.
If the Commission desires the Police Department seek a grant award it must authorize and direct the
Mayor to sign all application documents. If an award is offered it will be brought before the Commission
for consideration.

GRANT IN THE AMOUNT OF $50,000.00 THROUGH THE KENTUCKY OFFICE OF
HIGHWAY SAFETY FOR SPECIFIC TRAFFIC ENFORCEMENT AND EQUIPMENT FOR
THE PADUCAH POLICE DEPARTMENT
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to execute an application and all
documents necessary for a reimbursement grant through the Kentucky Office of Highway Safety
in the amount of $50,000.00. Said grant funds shall be expended for overtime traffic
enforcement activities and traffic enforcement related supplies and equipment for the Paducah
Police Department. No local cash or in-kind contribution is required.
SECTION 2, This Order shall be in frill force and effect from and after the date of
its adoption.

Background Information:
In accordance with the Water Resources Development Act of 2007 "WRDA" bill, the U.S.
Army Corps of Engineers (USACE) and the City of Paducah entered in a Floodwall Feasibility
Study and Certification of Levee System Agreement as authorized by Ordinance 92009-1-
7510. Subsequently, the USACE completed the Feasibility Report of the Paducah Levee
System in October 2010, aka "the Ohio River Shoreline, Paducah Kentucky LFPP
Reconstruction Project Feasibility Report," which recommended certain rehabilitation projects
to improve the reliability and restore system performance of the City's 60 -year old Floodwall.
On May 16, 2012, the USACE Chief's report recommended to the U.S. Congress the
implementation of the Paducah's Reconstruction projects noted within the Feasibility Report.
On July 17, 2012, the Board of Commissioners adopted Municipal Order #1678 authorizing
the Mayor to Execute a Letter of Intent to the USACE supporting the Reconstruction
Feasibility Report issued, to pledge cooperation with the Reconstruction Project and to offer
assistance in the initiation of the Preconstruction Engineering and Design (PED) activities
associated with the Reconstruction Project.
At this time, the USACE is prepared to begin the PED activities associated with the
Reconstruction Project. In order to implement the PED process, the City of Paducah will
need to execute a Design Agreement with the Department of the Army. This agreement
obligates the City to contribute 25 percent (25%) of the total design costs associated with the
Reconstruction Project, which is projected to be approximately $600,000. Therefore, the
City's approximate share for the design of the Reconstruction Project is estimated to be
$150,000 total. A portion of the City's required obligation can be credited by in-kind services
provided by City staff and/or outside sources.

Background Information:
The Paducah Renaissance Alliance, national Main StreetTM program, serves to
stimulate the economic vitality of the historic downtown and Lower Town Arts
District, while protecting the historic integrity of our community.
A Main StreetTM program relies on a strong volunteer base to form the Board
and Committees that implement the broad Four Point Approach strategy. Many
one-time volunteers are also needed for special events. Therefore, a larger
Board will expand the interest base and support group necessary to affect
change in the program work plan at all levels.

Background Information: The KLCIS Safety Award was established as a program to
assist local governments in reducing workers' compensation losses and improving employee and
public safety. The eligibility of the award amount is based on the KLCIS member's annual
combined insurance premium of less than $50,000, or more than $50,000. The city is eligible to
request up to $6,000.00, to be used for safety equipment. This is 50/50 cash match grant program.
On December 11, 2012 through Municipal Order #1697, the city commission approved the
Park Service Department to submit an application to the KY League of Cities Insurance
Services in the amount of $6,000 for the purchase of playground and safety equipment for
Paducah Parks Services Department. The 50% cash match will be paid through the Park
Service's budget.
The Kentucky League of Cities Insurance Services has offered the Park Services Department
an award in the amount of $6,000.00
If the Commission desires the Parks Services Department to accept the 2013 KLC Safety
Award it must authorize and direct the Mayor to sign all grant award documents.

WHEREAS, the City of Paducah applied for a Kentucky League of Cities 2013
matching Safety Grant Award adopted by Municipal Order No. 1697 on December 22, 2012,
2012, for the purchase of playground and safety equipment for the Paducah Parks Services
Department; and
WHEREAS, the Kentucky League of Cities has approved the application and is
now ready to award this grant.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to execute a Grant Agreement and
all documents relating thereto with the Kentucky League of Cities, for a 2013 matching Safety
Grant Award that will reimburse the City $6,000.00 for the purchase of playground and safety
equipment for the Paducah Parks Service Department. The matching funds of $6,000.00 will be
provided through the Parks Services Department budget.
SECTION 2. This expenditure shall be charged to the 2013 KLC Safety Award
account, 040-8821-536-2307, project account PA0099.

Background Information:
On January 31, 2013, sealed bids were opened and read aloud for the purchase of Structural
Firefighting Turnout Gear for use by the Paducah Fire Department for the 2013 and the 2014
Fiscal Year with a One Year optional renewal. Two bids were received, with Bluegrass Fire
Equipment Company, Inc., being the responsible bidder who submitted the responsive lowest
evaluated Unit Bid Price of $1,110.00 per set in accordance with the specifications. The Unit
Price will be utilized as the Contract Unit Price for the remaining portion of the City's 2012-
2013 Fiscal Year (ending June 30, 2013) and the City's 2013-2014 Fiscal Year (ending June
30, 2014). The term of the contract may be renewable for an additional One -Year fiscal year
term ending on June 30, 2015, upon the mutual agreement of both parties.

AGREEMENT FOR STRUCTURAL FIREFIGHTING TURNOUT GEAR
For use by the Paducah Fire Department
THIS AGREEMENT, made this day of , 2013 by and between the CITY OF
PADUCAH, hereinafter called the OWNER, and BLUEGRASS FIRE EQUIPMENT COMPANY, INC,
hereinafter called the VENDOR, for the consideration hereinafter named, agree as follows:
ARTICLE 1. SCOPE OF WORK
The Vendor agrees to furnish and deliver to the City of Paducah the Structural Firefighting
Turnout Gear for use by the Paducah Fire Department in full compliance with this Agreement, the
Specifications and any Addendum(s) issued.
ARTICLE 2. DELIVERY
During the contract time period, the Vendor shall deliver the number of Structural Firefighting
Turnout Gear as ordered by the City of Paducah Fire Chief within Twelve (12) weeks subsequent to the
receipt of a purchase order.
ARTICLE 3. THE CONTRACT SUM
The Owner shall pay the Vendor for the Structural Firefighting Turnout Gear as ordered at the
Contract Unit Price of $1,110.00 Per Set as contained in the Bid Proposal dated January 31, 2012, which
shall constitute full compensation for the materials authorized herein. Contract prices are firm and will
not be altered during the contract period. The Vendor agrees that no minimum amount of purchase shall
be required for the unit prices as quoted.
CONTRACT TIME
The term of the contract shall be a Two -Year Contract binding upon the City and the Seller, his
partners, successors, assigns, and legal representatives for the remaining portion of the City's 2012-
2013 Fiscal Year (ending June 30, 2013) and the City's 2013-2014 Fiscal Year (ending June 30,
2014). Neither the City nor the Seller shall have the right to assign, transfer, or sublet their interests or
obligations hereunder without consent of the other party.
The term of the contract may be renewable for an additional One -Year fiscal year term
ending on June 30, 2015, upon the mutual agreement of both parties. The City Fire Chief, acting as
agent for the Owner, shall determine, in his sole discretion, the option to renewal. Upon mutual
agreement to renew, both parties shall execute the One -Year Renewal Agreement prior to the expiration
of the existing contract.
ARTICLE 4. PAYMENTS
Payment will be made on or about thirty (30) days after submission of a properly completed
invoice and upon satisfactory delivery in accordance with the Contract Documents and the
Specifications.
ARTICLE 5. THE CONTRACT DOCUMENTS
The Specifications and any addendum that may have been issued are fully a part of this
Contract as if thereto attached or herein repeated.

Background Information:
On July 24, 2012, Ordinance #2012-7-7950 was adopted authorizing the Mayor to execute a
contract with Wilkins Construction Company, Inc., for the construction of the Greenway Trail
Phase I project in the amount of $543,759.00. Notice to Proceed was given to commence
work on August 13, 2012. At this time, all work on the project has not been substantially
complete. However, due to minor adjustments, a change order was required to finalize the
following items:
1. Items 206-209 have been deleted from the contract due to the Ohio River Boat Ramp construction
that will take place the Summer of 2013, The Greenway Trail Phase I and the Ohio River Boat
Launch Projects intersect at Burnett Street. The City of Paducah will install the necessary signage
and pavement markings at the completion of the Boat Launch Project.
2. Items 302, 305 and 501 are minor final contract quantity adjustments.
3. Item 306 adjustment is based on the final quantity of DGA material as verified by weigh tickets of
actual material installed.
4. Due to the prolonged manufacturing time period and delivery related to the Shelter Structures (Item
#201) and the Benches (Item #220) a Contract Time Extension is required. Therefore, this Contract
Time Period will be extended by Seventy (70) consecutive calendar days. The new Contract Time of
Completion will be February 19, 2013.
Therefore, with the deduction and addition of the aforementioned items, Change Order #1 will
increase the contract by $21,459.92, with the new contract amount being $565,218.92. This
change order has been approved by the Kentucky Transportation Cabinet as required by the
KYTC-LPA program.

AN ORDINANCE ACCEPTING THE ALTERNATE CONCRETE BID OF
WILKNS CONSTRUCTION CO., FOR THE CONSTRUCTION OF THE GREENWAY
TRAIL PHASE I PROJECT, AND AUTHORIMG THE MAYOR TO EXECUTE A
CONTRACT FOR SAME
BE 1T ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah accepts the alternate concrete bid of
Wilkins Construction, Co., in the amount of $543,759.00, for construction of the Greenway Trail
Phase 1 Project, said bid being in substantial compliance with bid specifications, and
advertisement for bids, as contained in the bid of Wilkins Construction, Co., of June 2S, 2012.
SECTION 2. That the Mayor is hereby authorized to execute acontract with
Wilkins Construction, Co., for construction of the Greenway Trail Phase I Project, authorized in
Section I above, according to the specifications, bid proposal and all contract documents
heretofore approved and incorporated in the bid.
SECTION 3. This expenditure shall be charged to the Greenway Trail Phase I
Account — PAO056.
SECTION 4. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
