HomeMy WebLinkAboutOrdinances Book 18, Page 5, Ordinance Number 73-1-7395 ORDINANCE NO. 73-1-739 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF CERTAIN PROPERTY LOCATED ON THE NORTH SIDE OF BROADWAY EAST OF THE I. C. AND GULF RAILROAD RIGHT -OG -WAY, AND AMENDING THE PADUCAH ZONING ORDINANCE -1971 SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on November 6, 1972, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF CERTAIN PROPERTY LOCATED ON THE NORTH SIDE OF BROADWAY EAST OF THE I. C. AND GULF RAILROAD RIGHT-OF-WAY", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification change and the map amendment proposed in said resolution be, and the same are hereby declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, changed from B-3,General Business Zone, to B-1 Convenience and Service Zone: 6/ ORDINANCE NO. 73-1-739 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF CERTAIN PROPERTY LOCATED ON THE NORTH SIDE OF BROADWAY EAST OF THE I. AND GULF RAILROAD RIGHT-OF-WAY, AND AMENDING THE PADUCAH ZONING ORDINANCE -1971 SO AS TO EFFECT SUCH REZONING BE 1T RESOLVED BY THE BOARD OF COtM1ISSI0NERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on November 6, 1972, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF CERTAIN PROPERTY LOCATED ON THE NORTH SIDE OF BROADWAY EAST OF THE I. C. AND GULF RAILROAD RIGHT-OF-WAY", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. SECTION 3. That the zone classification of the following property be, and it is hereby, changed from B-3, General Business Zone, to B-1, Convenience and Service Zone: Beginning at the point of intersection of the center line of Broadway with the dividing line between the American Legion and the Peoples Bank, if extended; thence in a westerly direction along and with the center line of Broadway a distance of 665 feet, more or less, to the east line of the Illinois Central, Gulf Railroad Company right-of-way; thence in a northwesterly direction, along and with said right-of-way line a distance of 223 feet to a point, said point being the intersection of the east right-of-way line of the Illinois Central, Gulf Railroad with the center line of a 25 foot alley running parallel with Broadway and Jefferson Streets and lying between 30th and 31st Streets, if the same were extended; thence in an easterly direction along and with the center line of said alley, if extended, a distance of 630 feet to the end of said alley, which point lies 150 feet east of the east line of 30th Street; thence at right angles and in a southerly direction a distance of 8 feet to a point; thence at right angles and in an easterly direction a distance of 104.67 feet to a point, corner to Peoples Bank and the American Legion; thence at right angles and in a southerly direction along and with the dividing line between the Peoples Bank and the American Legion a distance of 204.14 feet to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be in full force and effect from and after its adoption.
