HomeMy WebLinkAboutOrdinance Book 18, Page 997, Ordinance Number 75-9-1174997 ORDINANCE NO. 75-9-1179 AN ORDINANCE APPROVING AN INCREASE IN THE WATER RATES AND MINIMUM CHARGES FOR WATER SERVICE TO ALL CUSTOMERS OF THE PADUCAH WATERWORKS BOTH INSIDE AND OUTSIDE OF THE CORPORATE LIMITS OF THE CITY OF PADUCAH, KENTUCKY, AND FIXING WATER RATES AND MINIMUM CHARGES FOR SUCH SERVICES, APPROVING AND ESTABLISHING POLICIES AND PROCEDURES OF THE PADUCAH WATER WORKS, PROVIDING THAT NOTHING IN THIS ORDINANCE SHALL IMPAIR THE OBLIGATION OF ANY CONTRACTS NOW EXISTING BETWEEN THE CITY OF PADUCAH, PADUCAH WATER WORKS AND ANY WATER DISTRICTS, EXCEPT SUCH CHANGES AS MAY BE PROVIDED FOR AND PERMITTED IN SAID CONTRACTS OR BY LAW, AND FURTHER PROVIDING FOR THE REPEAL OF ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, are aware of the rising operating expenses and declining surplus income of the Paducah Water Works, and WHEREAS, certain major improvements to the Paducah Water Works are necessary to maintain a safe and adequate water supply for both existing and potential customers within the service area, and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, is in the process of arranging to finance the necessary construction of extensions, additions and improvements to the existing Paducah Water Works, and WHEREAS, it is necessary because of the rising cost of operating expenses, and in connection with said plan of financing for construction of extensions, additions and improvements, that the existing water rates and charges of said Paducah Water Works be increased, and WHEREAS, such increased rates and charges have been recommended by the Commissioners of the Water Works, i NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF C01nHSSIONERS OF THE. CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah accept the recommendation of the Commissioners of the Paducah Water Work% to increase water tortes and minimum charges for ::rater service to all customers both in!;ide and outside the corporate limits of the I, City of Paducah and to establish policiev and procedures of the Paducah Welter Works and that the City approve and ratify the following rotes and minimum charges to all customers of water both inside and outside the corporate limits, and to establish the policies and proci,dures as hereinafter ,et out. to -wit: 998 1. NEW {NATER RATES. That the rates for water service furnished by the Paducah water works are hereby fixed and established as follows: A. RATES INSIDE CITY LIMITS (a) Monthly Rates For water Service Inside City Limits Consumption Charges Per 1,000 Gallons 0 to 2,500 gallons per month 1.04 2,501 to 10,000 gallons per month .90 10,001 to 100,000 gallons per month .52 100,001 to 500,000 gallons per month .39 500,001 to 1,000,000 gallons per month .34 All over 1,000,000 gallons per month .29 (b) Minimum Monthly Charges The minimum monthly charge to customers inside the City Limits having a 5/8 inch meter shall be $2.60 per month, and each such customer shall be entitled to 2,500 gallons of water per month for such minimum charge. (e) Minimum, Di -Monthly Char (!*i 999 The minimum bi-monthly water bill shall be $5.20, and each customer shall ie entitled to 5,000 gallons of water for such bi-monthly period for such minimum rate. B. RATES OUTSIDE CITY LIMITS (a) Monthly Rates for water Service Outside City Limits (Exclusive of Surcharge) Consumption Monthly Charge Per 1,000 Gallons 0 to 10,000 gallons per month 1.18 10,001 to 100,000 gallons per month .65 100,001 to 500,000 gallons per month .52 Lit Over 500,000 gallons per month .42 (b) Minimum Monthly Charges The minimum monthly charge to customers outside the City Limits, having 5/8 inch meter, shall be $2.95 per month, and each customer shall be entitled 1 2,500 gallons of water per month for such minimum charge. CONNECTION CHARGES New customers of the Water Works located within the City limits shall pay a waterworks connection charge of $150.00 for 5/8 inch connection. New customers located within the City limits desiring a connection of 3/4 inch or larger shall pay the actual cost of meter setting, including labor and materials, plus an additional overhead cost not to exceed 20% of such actual cost. New customers of the Water Works who are not residents of the City shall pay a waterworks connection charge of $200.00 for a 5/8 inch connection. New customers who are not residents of the City desiring a connection of 3/4 inch or larger shall pay the actual cost of meter setting, including labor and materials, plus an additional overhead cost not to exceed 200 of such actual cost. IV. CUSTOMER PAYS COSTS OF RUNNING LINES ON HIS PREMISES Each customer is responsible for constructing and bearing the cost of running his water line from the building located on his premises to the point in his property line or casement where such water service has been brought or to such other point to which such water line has been brought by the City to serve his premises. 7 construction of said private lines shall be in accordance with the Paducah Water Works regulations for materials and construction. V. INDEMNIFICATION AND SUPERVISION j Each property owner shall indemnify the Paducah Water Works from any loss or damage that may directly or indirectly be occasioned by the construction of a water line from the respective premises to the point where the Paducah Water Works has I brought such line or lines, and all water connections shall be made under the supervision of the Director of the Paducah Water Works, or his authorized representative. :'I. EFFECTIVE DATE FOR NEW WATER RATES AND CHARGES The foregoing water rates and charges shall be effective as to existing water customers for the next regular billing beginning as s:arn as practicable after the effective date of thin Ordinance, and shall he effeetive as to the rospective premises of new water customers beginning on the elate on which tech cumomer connects his premises to the watfr lire m:,de available to such prerr&&. ;. VII. RATES ARE EXCLUSIVE OF SALES TAX The fn,regoirg rate; ore rates to be charged by the Paducah Water Works. and any applic-,bie State sales tax shall be added to each trill as a separate charge. 1001 VIII. ALL CUSTOMERS METERED: NO FREE SERVICE It shall be mandatory for all customers of the Paducah water works to be metered. No one shall receive or be entitled to free water service without paying the full rates herein specified. If any person is discovered using water from fire connections for any purpose other than fire purposes, such person shall be charged for such water the fire protection rate established in IA(c) and B(c) above, plus the applicable rates prescribed in IA(b) and B(b) above, and shall further be required, at his own expense, to install a meter on such connection. IX. REVISION OF RATES The schedule of rates and charges prescribed in this Ordinance shall be revised from time to time, and whenever required shall be increased, so as to produce income and revenues from said {Vater works adequate to comply with such covenants and agreements as may be made by the City in connection with any Revenue Bonds issued by the City. X. RECORDS AND AUDITS That the rates and charges for the use of and services rendered by the Paducah water works shall be billed and connected by the Utility, and the full amount of the proceeds for such service shall be deposited as received and set aside into the water revenue fund designated, in such manner as the Director of the water works may require, but subject to any different designation which may be made in any ordinance relating to the issuance of Revenue Bonds. The records of the Paducah water works with respect to charging, billing, collecting and accounting for water service shall be audited at least once each twelve months by an independent Certified Public Accountant, and n report thereof shall be filed with the City Clerk, or such report shall be filed in such manner and at such other time or times as may be provided in any ordinance relating to the issuance of F.evenue Bonds. The cost of such audit shall be classified and paid as an expense of operation and maintenance of the water Works. SECTION 2 Nothing in this Ordinance shall be construed to affect any Contract between the Paducah Water Works and any water district relative to the amount and method of charging said water district for wader furnished by the Paducah Water Works except insofar as the water rade incr•cas,e will, pursuant to said contract or contracts, increase the amount to be paid by ouch district. SECTION 3. If any clause, provision, paragraph or section of this ordinance shall he ruled void or uncnforceablo, by any court of competent jurisdiction. the remainder hereof Is intended to be enacted and shall be in full force and effect notwithstanding. 1002 SECTION 4. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 5.
