HomeMy WebLinkAboutOrdinance Book 18, Page 93, No Resolution Number93 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE KENTUCKY DEPARTMENT OF HIGHWAYS AND MCCRACKEN COUNTY, KENTUCKY, PERTAINING TO VARIOUS OBLIGATIONS WHICH WILL BE ASSUMED BY THE CITY OF PADUCAH, KENTUCKY, PERTAINING TO THE PROPOSED ELMDALE ROAD EXTENSION WHEREAS, on January 26, 1973, the City of Paducah, Kentucky, and the County of McCracken forwarded to the Kentucky Department of Highways a proposal outlining various commitments and obligations which the City and County would assume relative to the proposed Elmdale Road Extension from Jameswood Drive in Paducah to Bleich Road in McCracken i County, Kentucky, and WHEREAS, by letter dated February 20, 1973, the Kentucky Department of Highways has requested that the City of Paducah and County of McCracken adopt by formal resolution their willingness to fulfill the aforesaid obligations upon the construction of the proposed road, and WHEREAS, the Board of Commissioners feels that it is in the best interest of the City of Paducah, Kentucky, that said road be constructed, I NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That upon the Kentucky Department of Highways obtaining approval for and entering into the construction of the bridge and approaches to carry the Elmdale Road Extension over I-24; said extension runs from Jameswood Drive in Paducah, Kentucky, to Bleich Road in McCracken County, Kentucky, and across the proposed right- of-way of Interstate 24, the City of Paducah, Kentucky, in conjunction with and participation with the County of McCracken, will assume the following obligations: 1. The City of Paducah and McCracken County, Kentucky will obtain the right-of-way required for the proposed project outside of the right-of-way limits of Interstate 24. 2. The City of Paducah, Kentucky, and McCracken County, Kentucky will pay for any required utility relocations which would not have been necessitated by the proposed Interstate 24 construction. 3. The City of Paducah, Kentucky and McCracken County, Kentucky 94 will cause its portion of the proposed project to be con- structed prior to the completion of the bridge and approaches to be constructed with Interstate 24. 4. Upon completion of the proposed project, the City of Paducah will bear the responsibility for maintenance of that portion of the road inside the corporate limits of the City of Paducah, Kentucky, and it is understood that McCracken County, Kentucky, will maintain that portion which lies between the corporate limits and Bleich Road. 5. The City of Paducah, Kentucky and McCracken County, Kentucky, assume no obligations for the maintenance of the proposed bridge or supportins structures. SECTION 2. That the Mayor is hereby authorized to enter into any and all other necessary agreements with the Kentucky Department of Highways and McCracken County, Kentucky, in order to commit the City of Paducah, Kentucky to fulfilling the obligations more particularly set out in Section 1 above.
