HomeMy WebLinkAboutOrdinance Book 18, Page 695, Ordinance Number 74-10-1033695 ORDINANCE NO. 74-10-1033 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A RIGHT-OF-WAY EASEMENT TO THE ELECTRIC PLANT BOARD OF THE CITY OF PADUCAH, KENTUCKY D/B/A PADUCAH POWER SYSTEM FOR THE LOCATION OF UNDERGROUND ELECTRIC DISTRIBUTION LINES THROUGH PROPERTY OF THE CITY OF PADUCAH IN AND AROUND NOBLE PARK BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH,KENTUCKY: SECTION 1. That the Mayor and City Clerk be, and they are hereby, authorized to execute a right-of-way easement to Paducah Power System in consideration of and for the purpose of location of underground electric distribution lines, which right- of-way easement shall be in words and figures as follows: "In consideration, the adequacy and receipt of which is hereby acknowledged from the Paducah Power System, 1400 Broadway, Paducah, Kentucky, the undersigned owner (s) of the premises described below, do hereby grant to the Paducah Power System its licensees, agents, and successors, and assigns, a right-of-way easement to construct, operate, maintain, add or remove such lines or systems of electric power distribution facilities as the grantee may require, consisting of: (1) Poles, guys, anchors, aerial wires; (2) Buried cables, and wires, switches, transformers and enclosures; (3) Conduits, manholes, markers, underground cables and wires; (4) and other boxes, appurtenances or devices upon, over and under a strip of land 10 feet wide across the following lands in McCracken County, State of Kentucky, generally described as follows: Beginning at a point in Grantor's easterly property line, said property line being the common line between the City of Paducah and Paducah Junior Chamber of Commerce property, and being 56 feet in a northerly direction from the centerline of U. S. 60; thence in a westerly direction a distance of 909 feet to a point in Grantor's property, said point being 71 feet in a northerly direction from the centerline of U. S. 60; thence in a westerly direction a distance of 243 feet to a point 71feet in a northerly direction from the centerline of U. S. 60; thence in a westerly :i - rection a distance of 395 feet to a point 68 feet in a northerly direction from the centerline of U. S. 60; thence in a westerly direction a distance of 450 feet to a point 56 feet in a northerly direction from the centerline of IT. S. 60; thence in a westerly direction a distance of 468 feet to a point 60 feet in a northerly direction from the centerline of U. S. 60; thence in a westerly direction a distance of 690 feet to a point 80 feet in a northerly direction from the centerline of U. S. 60; said point being in Grantor's westerly property line. Beginning at a point in the above described centerline, said point being 205 feet in a westerly direction from Grantor's easterly property line; thence in a northerly direction and parallel with Grantor's easterly property line a distance of 145 feet, more or less, to a point, thence with an interior angle of 90 degrees a distance of 205 feet to a point in Grantor's easterly property line. and, to the fullest extent the undersigned has the power to grant, if at all, over, along and under the roads, streets or highways adjoining or through said property. The following rights are also granted: to allow any other person or company to attach wires or lay cable or conduit within the right-of-way for communications or electric power transmission or distribution; ingress and egress to said premises at all times; To have and to hold the above granted easement unto Paducah Power System, its successors and assigns forever." SECTION 2. This ordinance shall be in full force and effect from and atter its adoption.
