HomeMy WebLinkAboutOrdinance Book 18, Page 685, Ordinance Number 74-9-1027665 ORDINANCE NO. 74-9-1027 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY LOCATED BETWEEN BUCKNER LANE, FOREST AVENUE, RUSTIC AVENUE AND BROOKFIELD DRIVE, APPROVING THE PLAT OF SAID SUBDIVISION AND SUBDIVIDING SAID PROPERTY, SETTING BOND AMOUNT AND ACCEPTING THE DEDICATION OF THE PUBLIC RIGHTS- OF-WAY WHEREAS, the Paducah Planning Commission, by resolution dated August 19, 1974, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision, which was prepared by Seabrook, Lithgow & Kujath, Inc. and the subdivision reflected thereon, and accepting the dedication of the public rights-of-way and easements shown thereon, AND WHEREAS, pursuant to Section 12 (2) (b) the City Engineer has recommended a performance bond in the amount of $100, 000.00 to be posted by Seabrook, Lithgow & Kujath, Inc. for construction of streets, storn sewers, sanitary sewers, water lines, monuments, and other designated public improvements, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COAIMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on August 19, 1974, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY LOCATED BETWEEN BUCKNER LANE, FOREST AVENUE, RUSTIC AVENUE AND BROOKFIELD DRIVE", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled Hickory Acres Subdivision, and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public rights-of-way and public utility easements shown on said plat shall be, and they are hereby accepted, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the construction, improving or maintaining of said right-of-ways that being a matter for separate consideration and action. SECTION 4. That pursuant to Section 12 (2) (B) of the Paducah Subdivision Ordinance a performance bond in the amount of $100,000.00, with approved corporate 686 surety, and running to the City of Paducah is set and that said bond shall be in such form and containing such contents that meet the approval of the City Engineer and the Corporation Counsel of the City of Paducah. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 6. This ordinance shall be in full force and effect from and after its adoption.
