HomeMy WebLinkAboutOrdinance Book 18, Page 684, Ordinance Number 74-9-1026684 V� ORDINANCE NO. 74-9-1026 AN ORDINANCE CONDITIONALLY ACCEPTING THE BID OF COMCAST CORPORATION FOR RIGHTS TO A NON-EXCLUSIVE FRANCHISE TO OPERATE A CABLE TYPE TELEVISION SIGNAL DISTRIBUTION SYSTEM WITHIN THE CORPORATE LIMITS OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH,KENTUCKY: SECTION 1. That, subject to the provisions of Section 2 below, the City of Paducah conditionally accepts the bid of Comcast Corporation for rights to a non-exclusive franchise to operate a cable type television signal distribution system within the corporate limits of the City of Paducah, Kentucky, said bid being in substantial compliance with the Paducah Ordinance for Regulation of Cable Communications and the Advertisement for Bids as was authorized by Resolution passed by the Board of Commissioners on March 5, 1974, and also as was contained in the bid of Comcast Corporation dated June 3, 1974. SECTION 2. That the City of Paducah's acceptance of the bid of Comcast Cor- poration is conditioned upon the City of Paducah awarding a franchise in accordance with the Paducah Ordinance for Regulation of Cable Communications and the City of Paducah and Comcast Corporation entering into a satisfactory franchise agreement pursuant to the provisions of the Paducah Ordinance for Regulation of Cable Communications which franchise and franchise agreement shall be approved by the Board of Commissioners of the City of Paducah, Kentucky, after complying with Section V (4) of the Paducah Ordinance for Regulation of Cable Communications. SECTION 3. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 4.
