ORDINANCE NO. 73-10-889
AN ORDINANCE AMENDING SECTIONS 1, 2, 3, 10, 11 and 12 OF CHAPTER
27 "REFUSE" OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH,KENTUCKY:
SECTION 1. That Section 27-1 of the Code of Ordinances of the City of
Paducah, Kentucky, be amended and reordained so that said section as amended and
reordained shall hereafter read as follows:
"Sec. 27-1. Refuse Department- created.
There is hereby created a refuse department for the City of Paducah,
Kentucky".
SECTION 2. That Section 27-2 of the Code of Ordinances of the City of
Paducah, Kentucky, be amended and reordained so that said section as amended and
reordained shall hereafter read as follows:
"Sec. 27-2. Director - Position created.
There is hereby created the position of Director of the Refuse Department
of the City of Paducah, Kentucky."
SECTION 3. That Section 27-3 of the Code of Ordinances of the City of
Paducah, Kentucky, be amended and reordained so that said section as amended and
reordained shall hereafter read as follows:
"Sec. 27-3. Same - Duties.
The duties of the person occupying the position of Director of the Refuse
Department shall be to carry out all responsibilities assigned to him by ordinance and
by the City Manager, and to handle complaints by persons using the City's Refuse
collection system and to coordinate the collection of charges for the use of such system;
to handle complaints by persons using the services rendered by the municipal sewage
system and to coordinate the collection of charges for the use of such system; and to
perform all supervision and direction of the department, its equipment and personnel
in the operation of the collection system and the sanitary landfill."
SECTION 4. That Section 27-10 of the Code of Ordinances of the City of
Paducah, Kentucky, be amended and reordained so that said section as amended and
reordained shall hereafter read as follows:
"Sec. 27-10. Right of persons to transport and dispose of own refuse.
No provision of this Chapter shall be construed to prevent any person
from transporting or disposing of refuse produced by his own household or business

place, provided that such refuse is transported in a sanitary manner and is disposed of
in a lawful manner. Disposal by such means shall not exempt such person from the
obligation to pay the refuse collection service charges provided for under Article III
of this chapter."
SECTION 5. That Section 27-11 of the Code of Ordinances of the City of
Paducah, Kentucky, be amended and reordained so that said section as amended and
reordained shall hereafter read as follows:
"Sec. 27-11. Sanitary landfill - generally.
The City shall maintain a sanitary landfill at one or more sites for the
deposit and dumping of refuse and other wastes, which site or sites shall be designated
by the City Manager and operated in a manner as required by law and shall be open for use
as prescribed by the City Manager. The sanitary landfill shall be open for the use by all
vehicles in operation by the Refuse Department and for use by private collectors licensed
to dispose of collected waste at the City's landfill."
SECTION 6. That Section 27-12 of the Code of Ordinances of the City of
Paducah, Kentucky, be amended and reordained so that said section as amended and
reordained shall hereafter read as follows:
"Sec. 27-12. Same - Use charge.
Private collectors authorized to collect refuse in the City of Paducah,
Kentucky, and private commercial collectors operating within the limits of McCracken
County, Kentucky, shall be licensed upon their application to the City Treasurer to
dispose of collected waste and refuse at the City's Sanitary Landfill upon the purchase
of a dumping license as follows:
(a) For vehicles capable of carrying 16 cubic yards or less, there shall
be an annual dumping fee of $1,500.00.
(b) For vehicles with a load capacity between 16 cubic yards and 25 cubic
yards, there shall be an annual dumping fee of $1,750.00.
(c) For all vehicles with a capacity in excess of 25 cubic yards the
annual permit fee shall be negotiated with the City Manager.
(d) The foregoing license fees shall be paid to the City Treasurer who shall
issue a permit to the licensee for the period covered, and licenses may be issued on a
quarterly, semi-annual or annual basis.
(e) The rates for dumping permits shall be per vehicle used, and the permit
shall not be transferable except upon disposal of the collection vehicle by the licensee,
itat which time the licensee may transfer the license to the purchaser of the vehicle, or

may use the license with a new vehicle of an appropriate size acquired by the licensee
to replace a licensed vehicle.

(f) The City Treasurer shall forward a copy of all licenses issued to the
Director of the Refuse Department.
SECTION 7. Sections 1, 2 and 3 amend Section I of an ordinance originally
adopted July 10, 1956, and which was amended by Section 1 of an ordinance dated
May 10, 1958. Section 4 amends an ordinance adopted December 16, 1952, which was
last amended by Section 1 of an ordinance dated July 23, 1954. Section 5 amends
Section 1 of Article VII of an ordinance adopted December 16, 1952. Section 6 amends
an ordinance dated December 16, 1952, which was last amended by Section 1 of an
ordinance dated March 24, 1953.
SECTION 8. All ordinances and parts of ordinances in conflict herewith
are, to the extent of such conflict, hereby repealed.
SECTION 9. This ordinance shall be in full force and effect from and
after its adoption.
