HomeMy WebLinkAboutOrdinance Book 18, Page 310, Ordinance Number 73-8-876ORDINANCE NO. 73-8-876 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A QUITCLAIM DEED CONVEYING THE INTEREST OF THE CITY OF PADUCAH, KENTUCKY, IN CERTAIN PROPERTY LOCATED ON THE NORTHEAST SIDE OF FRIEDMAN LANE WHEREAS, the City of Paducah, Kentucky, entered into an agreement with Winfred E. Lynn and wife, Louise Lynn, for the widening and improving of Friedman Lane, and WHEREAS, pursuant to the terms of said agreement the City of Paducah, Kentucky agreed to convey its interest in the following described property, and WHEREAS, the terms of said agreement have been complied with and there is no just reason why said conveyance should not be made. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, Kentucky, pursuant to the terms of an agreement between the City and Winfred E. Lynn and his wife, Louise Lynn, convey to Winfred E. Lynn and his wife, Louise Lynn, the interest of the City in the following described property: Being a portion of Lot No. 1 located on the north side of Friedman Lane in St. Charles Court Subdivision, Paducah, McCracken County Kentucky, and more particularly described as follows: Beginning at a point, said point being at the northeast corner of herein described property and 75 feet from center line station 37+00 on Friedman Lane survey; thence southwesterly 95 feet along west right-of-way line of Heather Hill access road to a point being 30 feet from center line of Friedman Lane; thence northwesterly along north right-of-way line of Friedman Lane approximately 69 feet, more or less, to a point, being 30 feet from Friedman Lane center line survey Station 37+62; thence northeasterly and along common line between St. Charles Subdivision and Winfred E. Lynn property 72.6 feet more or less to a concrete monument; being on the southerly right-of-way line of Heather Bill access road; thence southeasterly and along southerly right-of-way line 60 feet, more or less, to point of beginning. Being in all respects the same property conveyed to the City of Paducah, Kentucky, from James Reeves and his wife, Margaret Reeves, by deed dated the 10th day of January, 1971, and recorded in Deed Book 529, page 382, in the office of the McCracken County Court Clerk. SECTION 2. That the Mayor and City Clerk are hereby authorized and directed to convey to Winfred E. Lynn and his wife, Louise Lynn, in survivorship, all the right, title and interest of the City in the properly described in Section I hereof, and said deed of conveyance shall be quitclaim only, shall contain no warranty as to title, and shall be subject to any state of facts that might be shown by an accurate survey.
