HomeMy WebLinkAboutOrdinance Book 18, Page 25, Ordinance Number 73-1-74825 ORDINANCE NO. 73-1-748 AN ORDINANCE DESIGNATING THE CITY OF PADUCAH, KENTUCKY, AS A BIRD SANCTUARY AND CREATING SECTION 4-8 "UNLAWFUL MOLESTING OF FOWL", OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY WHEREAS, it is in the best interest of the citizens of Paducah, Kentucky, to protect all species of birds or wild fowl and to provide for their preservation by the protection of law, and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, has found and determined that there is a need to designate the City of Paducah, Kentucky, as an official bird sanctuary, NOW THEREFORE, BE IT:ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the entire area embraced within the corporate limits of the City of Paducah, Kentucky, be, and the same is hereby designated as a, Bird Sanctuary. SECTION 2. That it shall be unlawful to trap. shoot, hunt, or attempt to shoot or molest in any manner any bird or wild fowl or to rob bird nests or wild fowl nests. Provided, however, if any species of birds or wild fowl are found to be congregating in such numbers in a particular locality that they constitute a nuisance or menace to the health or property of the citizens of Paducah, Kentucky, in the opinion of the State Department of Health, then in such event said birds or wild fowl may be destroyed in such numbers and in such manner as is deemed advisable by said health authorities under the supervision of the Chief of police of the City of Paducah, Kentucky. SECTION 3. Anyone violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction shall be fined not less than $25.00 nor more than $100.00 for each violation, and each separate act in violation of this ordinance shall be considered a separate offense. SECTION 4. That this ordinance shall be in full force and effect from and after its adoption.
