HomeMy WebLinkAboutOrdinance Book 18, Page 149, Ordinance Number 73-3-788149 v ORDINANCE NO. 73-3-788 I, AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING II COMMISSION RESPECTING THE AMENDMENT OF SECTION 83 OF THE PADUCAH ZONING ORDINANCE -1971 BY ADDING THERETO A NEW SUB -SECTION TO BE KNOWN AS 83.03, AND AMENDING SAID ORDINANCE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on February 19, 1973, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED AMENDMENT OF SECTION 83 OF THE PADUCAH ZONING ORDINANCE -1971 BY ADDING THERETO A NEW SUB -SECTION TO BE KN014N AS 83.03", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That Section 83 of the Paducah Zoning Ordinance -1971 be, and the same is hereby, amended by adding thereto a new sub -section I to be known as 83.03 which shall read as follows: I "SECTION 83. Amendments. 83.03 The Planning Commission, as a condition to the granting of any zoning change, may require the submission of a develop- ment plan which, where agreed upon, shall be followed. As a further condition to the granting of a zoning change, the Planning Commission may require that substantial construction be initiated within a certain period of time of not less than one year; provided that such zoning change shall not revert to its original designation unless there has been a public hearing." SECTION 3. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for j any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 4. This ordinance shall be in full force and effect from and after its adoption.
