ORDINANCE NO. 75-9-1178
AN ORDINANCE AMENDING ARTICLE (V OF THE CODE OF ORDINANCES
OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH,KENTUCKY:
SECTION 1. That Article IV Toxic Glue, of the Code of Ordinances of
the City of Paducah, Kentucky, be amended and reordained so that said Article as
amended and reordained shall hereafter read as follows:
"ARTICLE IV . Toxic Substances
Sec. 19-86. Definitions.
As used in this article the word "person" includes any corporation,
association, partnership, or one or more individuals. The words "large quantity"
means any sale of six (6) or more containers of toxic glue of any size at any one sale
or within a period of seven (7) days or less. As used in this article "toxic substances"
means any substance that will produce fumes which, when inhaled, will intoxicate or impair
the physical or mental functioning of a person.
Sec. 19-87. Penalty for violation of article.
Any person who violates any section of this article shall be punished
by a fine of not less than one hundred dollars ($100.00) nor more than five hundred
dollars (5500.00), or by imprisonment in the city jail of the City of Paducah, Kentucky,
for not less than ten (10) days nor more than one hundred eighty (180) days, or both.
Sec. 19-88. Being under influence of fumes unlawful.
It shall be unlawful for any person to be under the influence of toxic
substance fumes.
Sec. 15-89. Breathing fumes unlawful.
No person shall attempt to breathe toxic substance fumes for the purpose
of becoming under the influence of the rnme.
See. 19-90. Sales, etc., to persons under the influence of fumes, etc.
No person shall sell, supply, or furnish, or cause to be sold, supplied,
or furnished, any toxic substances to another person who in under fhe influence of
toric substance fumes or who intends to use the toxic snbstancer: for tmeh it purpose.
sec. 19-91. Retail sale of toxic glue: information required fron, large qunutity
purchasers; reports to prlice.

Any person who sells toxic glue at retail shall require any person who buys
a large quantity of toxic glue to furnish the seller the name, address and age of the
purchaser before the sale is made, and the person selling the same shall immediately
furnish this information to an officer of the police department of the City of Paducah,
Kentucky.
Sec. 19-92. Sales by persons convicted under this article.
It shall be unlawful for any person who is convicted under any section of
this article or a like or similar ordinance or statute in any other jurisdiction, to sell,
furnish, supply or possess toxic substances.
Sec. 19-93. Use of confidential information in court proceedings.
In any criminal trial or proceeding in any court involving an alleged
violation of any section of this article, any information communicated to a peace officer
by a confidential informant shall be admissable on the issue of reasonable or probable
cause to make an arrest or search with or without a warrant without requiring that the
name or identity of the information be disclosed, if the judge is advised after hearing
evidence in chambers out of the presence of everyone but the witness and the attorney
prosecuting the case that the information was received from a reliable informant."
SECTION 2. This ordinance amends Ordinance No. 68-12-146 which was
adopted by the Board of Commissioners on December 19, 1968.
SECTION 3. This ordinance shall be in full force and effect from and
after the date of its adoption.
