I A RESOLUTION ESTABLISHING A MAJOR SIDEWALK IMPROVEMENT PROJECT IN THE i CITY OF PADUCAH, KENTUCKY, DESIGNATING THE AREA OF THAT PROJ17CT AND ITS NATURE i AND CHARACTER, DECLARING THE NECESSITY FOR THE PROJECT AND THE NECESSITY FOR REQUIRING THE PADUCAH POWER SYSTEM AND ALL PERSONS USING ELECTRICAL SERVICE IN THE AREA OF SAID PROJECT TO PLACE ALL ELECTRICAL WIRES AND CONDUITS FOR WIRES BELOW THE SURFACE OF THE GROUND KENTUCKY: BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, SECTION 1. That the preservation of the downtown area in the City of Paducah, Kentucky, is vital to the health, safety and material well-being of the citizens and inhabitants thereof, and that the construction of a sidewalk improvement project, to be hereinafter known as the TOWNLIFT PROJECT, in the area hereinafter designated will contribute to the safe and effective movement of persons, and serve the public health, safety, convenience, enjoyment and general welfare, and will serve and protect the interests of the public in the safe and effective movement of persons, and preserve and enhance the function, appearance, and economic viability of the central merchantile and business district of the city, maintain the present high level of economic prosperity of business in the area, and thereby preserve the City's tax base created by the real estate and businesses which are located within the aforesaid area. SECTION 2. The present system of overhead electric distribution wires and poles in much of the downtown business district in the City of Paducah, including all of the area hereinafter described, is determined to be nearing the point of obsolescence both with respect to design capacity and with respect to conditions resulting from wear and tear and subjection to the elements over the years, so that extensive repairs, redesign, and replacement of components is now or will in the immediate future become necessary, and it has been determined it i to the complete satisfaction of the Board of Commissioners of the City of Paducah that underground i electric wiring is more desirable, presents fewer hazards to the general public, and is esthetically more pleasing than the existing system of overhead wires. SECTION 3. The proposed sidewalk improvement project, known as the Townlift Project, shall encompass the right-of-wny of Broadway from the westerly right-of-way line of First Street to the westerly richt-of-way line of Seventh Street, and all of the right -of - i' way of Second Street, both east nn] west of the Market ltouso, between Broadway and the northerly right-of-way line of Kentucky Avenue. SECTION 4. The character and nature of the TOWNLIFT PROJECT shall consist of a reconstruction of sidewalks in the project area so as to include. planting areas, benches, waiting sirens, and other esthetic and utilitarion improvements, the removal of all Riverhead electrical wires and conduits and their underground placement, 1064 and re-establishment of curb lines and parking places so as to retain substantial on - street parking and the retaining of sufficient street width to permit the safe and free passage of vehicular traffic through the area. SECTION 5. The re-establishment and improvement of sidewalks in the townlift area, in conjunction with the relocation of electrical wires, service entrances, and conduits underground, has been determined to be and hereby is declared a public necessity. SECTION 6. The relocation of all electrical wires, service entrances, and conduits underground in the area of the Townlift Project, in conjunction with the improvement of sidewalks, curbs, etc. , has been determined to be and is hereby declar a public necessity, and upon the passage of an ordinance by the Board of Commissioner: of the City of Paducah providing for the making of the improvement known as TOWNLIFT PROJECT, the Paducah Power System and all persons using electrical wires, service entrances, and conduits in the area of the TOWNLIFT PROJECT, shall be required to place all electric wires, service entrances, and conduits for electric wires below the surface of the ground. SECTION 7. There is hereby established a proposed project to be known as the TOWNLIFT PROJECT pursuant to KRS 94.291, et seq. , to be implemented through the joint cooperation of the City of Paducah, the Paducah Power System, Western Kentucky Gas Company, the Paducah Water Works, South Central Bell and the owners of real property located within the area set forth in Section 3 above. The area of responsibility of the City of Paducah shall be relocation or replacement of storm and sanitary sewer facilities where said facilities are in conflict with the electrical or other proposed improvements, and the reconstruction of sidewalks following the placement of utilities beneath the surface of the ground. The area of responsibility of the Paducah Power System shall be the demolition of presently existing sidewalks, the removal of its overhead electrical system and providing underground distribution wiring and conduits. The Paducah Power System shall also install customer service entrance conduits to within six inches of the property line of each individual electrical user. The areas of responsibility of the Western Kentucky Gan Company, the Paducah Water Works, and South Central Bell shall be the rerouting of gas, water and telephone facilities, owned by said utilities, where necessary In order to achieve implementation of the entire planning concept. No utility shall, for the sole, convenience or benefit of another utility, be required to reroute its facilities of its own expense, where its lacthtics do net interfere with the sidewalk or street Construction. R11IR The areas of responsibility of each individual real property owner within the project area designated shall be to provide the necessary electrical service for his realty from the Paducah Power System customer service entrance conduit (which shall end six (6) inches, more or less, from the property line) through the wall or foundation of his structure, and to provide all wiring, beginning at the Paducah Power System junction box, including all rewiring that may be necessary within the interior of his structure; and, to relocate his water service line (between the Paducah Water Works meter box and his realty) where necessary to clear the Paducah Power System underground conduit. It shall further be the responsibility of each individual real property owner to schedule his portion of the reconstruction so as to not impede the progress of the project. SECTION 8. A portion of the cost to the City of Paducah shall be assessed against the owners of abutting property, other than governmental agencies equally according to the number of abutting feet, provided, however, that the owners of lots abutting two sides of the project shall be assessed for only one-half of the abutting feet along the shorter abutting side. SECTION 9, The City Clerk shall cause this resolution to be published in full pursuant to Chapter 424 of the Kentucky Revised Statutes, and a hearing regarding the enactment of an ordinance providing for the making of the aforesaid public improvement shall be conducted on October 14, 1975, at 7: 30 p.m. , at City hall, Paducah, Kentucky. SECTION 10.
