JOHNSON A LEASE TO CERTAIN LAND OF THE CITY OF PADUCAH, FRONTING ON THE OHIO RIVER NEAR TERRELL (NORTHVIEW) STREET BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor and City Clerk be, and they are hereby, authorized and directed to execute, on behalf of the City, a lease to James C. Johnson in words and figures as follows.- "THIS ollows: "THIS LEASE, made and entered into on this the day of December, 1971, by and between the City of Paducah, Kentucky, a municipal corporation of the second class, hereinafter called "Lessor", and James C. Johnson of Paducah, Kentucky, hereinafter called "Lessee". W I T N E S S E T H: THAT for and in consideration of the hereinafter rental and subject to the hereinafter terms and conditions, the Lessor does hereby lease to the Lessee certain land of the Lessor in the city described as follows: Beginning at a point on the normal pool stage water line of the Ohio River 50 feet west of the northwest corner of the intersection of Terrell (Northview) Street, if extended; thence in a southerly direction and parallel to the line of Terrell Street, if extended, a distance of 150 feet, said line being coextensive with the line of property leased by the City of Paducah to James C. Johnson on July, 1971; thence at a right angle and in an easterly direction 50 feet to the west line of Terrell Street, if extended; thence at a right angle and in a southerly direction 285 feet, more or less, to a point; thence at a right angle and in a westerly direction 550 feet to a point; thence at a right angle and in a northerly direction and along a line parallel to Terrell Street, if extended, a distance of 435 feet, more or less, to the water line of the Ohio River at normal pool stage; thence in an easterly direction and following the line and meanders of the Ohio River 500 feet, more or less, to the point of beginning, containing approximately 5-1/3 acres of land. The duration of this lease is for a term of five (5) years with option to renew for an additional five (5) years, subject, however, to the right of cancellation by either party on six (6) months notice. The rental to be paid by the Lessee to the Lessor shall be Twenty-five Dollars ($25.00) per month, payable in advance. The herein leased land is to be used by the Lessee for tieing up barges and for the storage of scrap for compacting and loading on barges and for other purposes incidental thereto, and any improve- 850 ments or structures placed on said land shall be removed by the Lessee at the expiration of this lease. The leased premises shall not be under -let in whole or in part, nor assigned by the Lessee without the approval by official action by the Board of Commissioners of the City. It is the intention of the Lessor that the Lessee shall have full, complete, peaceable possession of the leased premises for the term set out herein, however, should this lease be cancelled and held for naught by operation of law, the Lessor shall not be liable to the Lessee for any damages by reason of such termination. The execution by the Lessor is authorized by a Resolution adopted by the Board of Commissioners of the City of Paducah, Kentucky, on the 14th day of December, 1971.
