HomeMy WebLinkAboutOrdinances Book 17, Page 769, Ordinance Number 71-10-547769 ORDINANCE NO. 71-10-547 AN ORDINANCE RECITING THE NEED FOR THE ACQUISITION OF CERTAIN LAND FOR A SANITARY SEWER EASEMENT TO SERVICE LOURDES HOSPITAL, AND PROVIDING FOR THE PAYMENT EOR THE PROPERTY TO BE ACQUIRED BY THE GRANTING OF TAP. -.ON RIGHTS WHEREAS, the City of Paducah has found it necessary to extend sanitary sewers from the Bellemeade Subdivision area across Lone Oak Road to the new Lourdes Hospital, and WHEREAS, the only feasible area for the laying of said sewer lines is across the Ezzell property in the north corner of the intersection of U. S. 45 and Kennedy Road, and WHEREAS, the owners of said property have agreed to convey the required easement for the rights to place six (6) single tap -ons to the City's sanitary sewer for commercial, multi -family or individual residences within the said Ezzell tract across which the said line wi1:1 be located. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager be, and he is hereby, authorized to execute an agreement between the City of Paducah, Kentucky, and T. C. Ezzell, Mary Miller Ezzell, Juliette K. Ezzell and T. C. Ezzell, Trustee, wherein the City of Paducah would grant the right to said parties to place six (6) free sewer tap -ons on a sanitary sewer to be constructed across their property, in exchange for a grant of a permanent sanitary sewer easement from said parties, said easement being more particularly described as follows: Being a 10' wide Otrip adjacent to and parallel to the northerly right-of-way line of U. S. 45 (Lone Oak Road), beginning at the northeasterly intersection of U. S. 45 and Kennedy Road right-of-way lines; thence running N560 -38'-51"E adjacent to and parallel to the northerly right-of-way line of U. S. 45 a distance of 525'. SECTION 2.
