ORDINANCE NO. 71-9-533
AN ORDINANCE CLOSING ALL OF THE EXISTING ALLEYWAY SITUATED
BETWEEN BROADWAY AND KENTUCKY AVENUE AND 24TH STREET AND 25TH STREET
WHEREAS, by ordinance dated September 26, 1967, the Board of
Commissioners authorized the closing of all that portion of a twenty-five
foot alley located between Broadway and Kentucky Avenue and extending
east from 25th Street toward 24th Street a distance of 150 feet, and
WHEREAS, by Judgment of McCracken Circuit Court on January 2,
1968, in the action styled City of Paducah vs. Tuholsky, et al, the
said portion of said alley was closed, and
WHEREAS, the Western Baptist Hospital has now acquired all land
in the said block and desires that all alleyways be closed, and
WHEREAS, this Board finds that an alley will not be necessary
for servicing any part of the property within the block and that there
is no alley extending west beyond 25th Street,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah, Kentucky, does hereby
authorize the closing of all the existing alleyways in the block bounded
by Broadway on the north, Kentucky Avenue on the south, 24th Street on
the east and 25th Street on the west, and specifically all that portion
of a 25 foot alley running parallel to Broadway and Kentucky Avenue
and extending west fromihe west line of 24th Street to a point 150 feet
east of the east line of 25th Street.
SECTION 2. That the Corporation Counsel of the City of Paducah,
Kentucky, be, and he is hereby, authorized and empowered to institute
and prosecute pursuant to Section 94.360 of Kentucky Revised Statutes
an action in the McCracken Circuit Court for a judgment ordering the
closing of said alleyways as set forth in Section 1 hereof.
SECTION 3. This ordinance shall be in full force and effect
from and after its adoption.
