HomeMy WebLinkAboutOrdinances Book 17, Page 718, Ordinance Number 71-7-517718, ORDINANCE NO. 71-7-517 AN ORDINANCE AUTHORIZING THE EXECUTION AND DELIVERY OF A PERMANENT EASEMENT AND MAINTENANCE AGREEMENT FROM THE CITY OF PADUCAH TO THE COMMONWEALTH OF KENTUCKY, DEPARTMENT OF HIGHWAYS, GRANTING PERMISSION TO CROSS THE PADUCAH FLOOD PROTECTION LEVEE BETWEEN STATION 66+40.14 AND 72+15.21, SECTION "C" BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor be, and he is hereby, authorized to execute, on behalf of the City of Paducah, Kentucky, a permit con- stituting a permanent easement to the Commonwealth of Kentucky, Department of Highways, authorizing the grantee to cross the Paducah Flood Protection Levee between Stations 66+40.14 and 72+15.21, Section "C", for the purpose of constructing a portion of Interstate Highway 24, said conveyance to include special conditions for the permanent maintenance and repair by the grantee of the portion of the levee so conveyed. The said permit shall further include a provision that the Kentucky Department of Highways shall reimburse the City of Paducah for the cost of the right-of-way granted, and said cost shall be arrived at by mutual agreement as soon as funds are available for right-of-way acquisition. SECTION 2. This ordinance shall be in full force and effect from and after its adoption.
