HomeMy WebLinkAboutOrdinances Book 17, Page 603, Ordinance Number 71-5-470603 ORDINANCE NO. 71-5-470 AN ORDINANCE AMENDING SECTIONS 1 AND 2 OF ORDINANCE NUMBER 70-9-377 ENTITLED "AN ORDINANCE RECITING THE NEED FOR ACQUIRING CERTAIN LAND FOR THE WIDENING OF FRIEDMAN LANE, PROVIDING FOR A SHARING OF COST WITH THE COUNTY OF McCRACKEN, PROVIDING FOR THE PAYMENT OF FUNDS FOR PROPERTY TO BES ACQUIRED WITHIN THE CITY, AND AUTHORIZING THE CONDEMNATION OF SUCH PROPERTIES AS CANNOT BE ACQUIRED AT THE AUTHORIZED OFFERED PRICE", WHICH ORDINANCE WAS ADOPTED SEPTEMBER 18, 1970 WHEREAS, subsequent to the adoption of the above titled ordinance, the City of Paducah and County of McCracken mutually agreed that the County of McCracken would make all acquisitions of property necessary for right of way to widen Friedman Lane as was set out in said ordinance, and WHEREAS, it was agreed between the parties that all costs would be shared equally, and WHEREAS, the costs are now known and authorization is needed to pay the City's share of the cost for the project, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 1 of the ordinance bearing the title quoted above be amended and reordained so that said section shall hereafter read as follows: "SECTION 1. That the City Treasurer be, and he is hereby, authorized to pay the sum of $9,322.90 to McCracken County, Kentucky, for the City of Paducah's one-half of the following amounts expended to acquire the below listed parcels of right-of-way for the widening of Friedman Lane between Pines Road and U. S. Highway 60: 2=4RCEL OWNER DAMAGES 6, 7 & 8 Tomas A. Paxton, Carolyn Elizabeth Paxton & Elizabeth Carney Paxton $1,400.00 10 R. M. McCune Estate and Glenna McCune (Widow) 3,000.00 13 James R. Reeves and Margaret H. Reeves, his wife 5,000.00 John W. Keiler Estate 500.00 Gwendolyne Fields Weircioch 1,050.00 Dumas Fields & Flora Fields, his wife 2,500.00 Winfred E. Lynn & Louise Lynn, his wife 2,000.00 604 Harry H. Hester & Berlene Hester, his wife $2,400.00 H. L. Duncan & Dorris L. Duncan, His wife 645.80 William Grey Skinner and Carolyn N. Skinner; his wife .00 Fees for three condemnation connissioners 150.00 18,645.80 " SECTION 2. That Section 2 of the ordinance bearing the title quoted above be amended and reordained so that said section as amended and reordained shall hereafter read as follows: "SECTION 2. That the City Treasurer be authorized to pay to the County of McCracken any sum not exceeding the amount of $4,000.00 representing the City's one-half share of any and all costs for the relocation of water utility lines by the Paducah Water Works in the project area; provided, however, that there shall be deducted from said sum the amount of $600.00 representing one-half of the sewer tap -on credits extended to Charles E. Moore and Jo Lucille Moore, his wife, as consideration for the acquisition of the right-of-way across their property in the Friedman Lane Project." SECTION 3. An emergency is declared to exist, and this ordinance shall therefore be introduced and remain on file for one (1) week in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect immediately thereafter.
