HomeMy WebLinkAboutOrdinances Book 17, Page 466, Ordinance Number 71-2-439466 J/ ORDINANCE NO. 71-2-439 AN ORDINANCE AUTHORIZING THE PURCHASE OF CERTAIN LAND FROM BOYD STONE COMPANY, INCORPORATED, TOGETHER WITH VARIOUS PIECES OF EARTH MOVING EQUIPMENT, FIXING THE PURCHASE PRICE OF SAME, AND PROVIDING THE TERMS AND PROVISIONS OF SUCH PURCHASE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, Kentucky, purchase from Boyd Stone Company, Incorporated, the following described land in McCracken County, Kentucky, to -wit: Beginning at a stake or stone in the Paducah and Woodville Road (1892) with red oak and post oak pointers; thence north 15 1/4 degrees east 299 poles to a stake with 5 red oaks; thence north 73 3/4 degrees west 76 2/3 poles to a stake, 3 white oaks; thence south 15 3/4 degrees west 331 poles to a stake in Tom Ware's line, persimmon pointer and in the woodville Road (1892); thence south 79 1/4 degrees east 76 2/3 poles to the beginning, containing 150 acres, more or less, but excepting the following described tract of land conveyed to T. W. Luttrell, which is described as follows: Beginning at a corner to Rives Heirs land in Harvey Waldon's line, with red oak marked for a pointer; thence with the line of Waldon South 74 degrees east 76 2/3 poles to a rock, corner to Dr. Chiles; thence with the line of Chiles South 14 1/4 degrees west 44 4/5 poles to a rock in the bank of West Massac Creek; thence with the meanderings of said Creek north 83 degrees west 8 poles, whence south 73 degrees west 12 poles, thence south 58 degrees west 14 poles, thence south 67 degrees west 6 4/5 poles, thence south 86 degrees west 11 1/5 poles, thence south 88 degrees west 18 poles, thence south 40 degrees west 7 2/5 poles; thence south 33 degrees west 17 3/4 poles, thence south 87 degrees west 5 poles to a stone in Rives Heirs line, with birch pointer; thence with said line north 16 1/4 degrees east 99 poles to the beginning, containing 30 acres. Also less and except 5 acres, more or less, sold to McCracken County for gravel purposes to the brink of the hill off the southeast corner. Also excepting and less 80 acres of land out of said above described tract as follows: beginning at a stake or stone in the Paducah and Woodville Road, as located in 1892, with red oak and post oak pointers; thence north 15 1/4 degrees east 2645 feet to a stake; thence north 76 degrees west 1230 feet to the northwest line or side of the N. F. Vance property; thence south 15 3/4 degrees west 3142 feet to a stake in Tom Ware's line and in the Woodville Road, as located in 1892; thence south 79 1/4 degrees east with said road to the point of beginning. 467 Said tract herein conveyed contains 34 acres of land, more or less. Being the same property conveyed to Boyd Stone Company, Incorporated, by deed dated February 19, 1970, of record in Deed Book 516, page 510, McCracken County Court Clerk's office. SECTION 2. That the City of Paducah, Kentucky, purchase from Boyd Stone Company, Incorporated, along with the real estate described in Section 1 above, the following described machinery and equipment now located on said land: 1 1952 D-8 Caterpillar -Dozer 1 1956 955 Caterpillar -Dozer SECTION 3. The purchase 1brice to be paid for land and equipment described in Sections 1 and 2 shall be $25,000.00, which sum shall be paid from Account No. SECTION 4. An emergency is declared to exist and this ordinance shall be introduced and remain on file for public inspection for at lease one (1) week in the completed form in which it shall be -put upon its final passage, and if adopted shall be in full force and effect immediately thereafter.
