HomeMy WebLinkAboutOrdinances Book 17, Page 455, Ordinance Number 71-2-437455/ ORDINANCE NO. 71-2-437 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE INSTITUTE OF ELECTRONIC TECHNOLOGY FOR THE PURPOSE OF PROVIDING WORK TO STUDENTS ELIGIBLE TO PARTICIPATE IN THE COLLEGE WORK STUDY PROGRAM BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH,'KENTUCKY: SECTION 1. That the City Manager be, and he is hereby, authorized to execute a contract between the City of Paducah, Kentucky and the Institute of Electronic Technology for the purpose of providing work to students eligible to participate in the college work study program, said contract to be in words and figures as follows: "THIS AGREEMENT made and entered into on this the day of February, 1971, by and between the INSTITUTE OF ELECTRONIC TECHNOLOGY, a division of Electronic Sales Engineers, Inc., an Indiana Corporation, doing business in the City of Paducah, Kentucky, hereinafter known as the "Institution" and the CITY OF PADUCAH, KENTUCKY, hereinafter known as the "Organization" a, public organization within the meaning of the term as defined in Section 175.2 of the College Work -Study Regulations, for the purpose of providing work to students eligible to participate in the College Work -Study Program, W I T N E S S E T H "That for and in consideration of the mutual promises herein contained, the parties agree as follows: A. The Institution shall: 1. Provide a minimum of twenty-five students for work for and with the organization, which workers shall work an average of fifteen hours per week per student. 2. Pay eighty percent of all wages and tax assessments paid pursuant to this agreement, together with all costs for workman's compensation, and make and account for all payrolls. B. The Organization shall: I. Employ and supervise all acceptable students referred to the Organization by the Institution. To be acceptable all students must meet minimum physical and mental 456 employment standards of the City and comply with all work rules and orders from supervisors. 2. Provide transportation for all student workers to the jpb site location and to transport them back at the end of their work schedule. 3. Pay to the Institution twenty percent of the cost of all wages earned by the student workers, and pay said sums to the Institution on a monthly basis within ten days after billing. C. The parties mutually agree: I. That schedules may be attached to this agreement from time to time bearing the signature of an authorized official of the Institution and of the Organization, which may set forth brief descriptions of the work to be performed by the students under this agreement, the total number of students to be employed, and the hourly rates of pay, and the average number of hours per week each student will be utilized, provided all changes are within the limits of this contract or the regulations of the College Work -Study Program. 2. The Institution will inform the Organization of the maximum number of hours per week each student may work, during the Summer or other period of non-regulat enrollment during which the student is attenting classes. 3. Students will be made available to the Organization by the Institution for performance of specific work assignments. Students may be removed from work on a particular assignment or from the Organization by the Institution, either on its own initiative or at the request of the Organization. The Organization agrees that no student will be denied work or subjected to different treatment under this agreement on the grounds of race, color, sex, or national origin, and that it will comply with the provisions of the Civil Rights Act of 1964, and the regulations of the Department of Health, Education and Welfare. 11 457 4. The Organization shall be deemed the employer for the purposes of this agreement. It has the right to control and direct the services of the students, not only as to the result to be accomplished, but also as to the means by which the result is to be accomplished. The Institution shall be limited to determining that the students meet the eligibility requirements for employment under the College Work -Study Program, to assigning students to work for the organization, and to determining that the students do perform their work in fact. 5. The work to be performed by the students shall be in such areas as clean-up, beautification, weed cutting, housing code enforcement, demolition of sub -standard housing, rat abatement, and as may otherwise be assigned to them, but such work shall be in the public interest and shall not result in the displacement of employed workers or impair existing contracts, shall not involve any activity for the benefit of a religious group or religious worship, and shall not involve any political activity associated with a candidate or contending factor or group. 6. The minimum hourly rate to be paid the students shall be $1.65 per hour for regular workers and $2.00 per hour for students performing supervisory work. 7. The duration of this contract shall be a maximum of twelve months, and the effective date of this contract shall be January 1, 1971, and the final termination date shall be December 31, 1971, if not sooner terminated. 8. The compensation of students for work performed on the project under this agreement will be disbursed by the Institution, all payments due as an employer's contri- bution under state and local workman's compensation laws will be made by the Institution, and all payments due under federal and state social security laws or under 458 other applicable laws will be made by the Institution, but the Organization shall reimburse the Institution for twenty percent of all payments for compensation and other such benefits as may be paid by the Institution. 9. The Organization's liability hereunder shall not exceed the total amount of $6,000.00. IN WITNESS WHEREOF, the parties hereto by and through their duly authorized representatives do execute this contract on the day and date first above written." SECTION 2. This ordinance shall be introduced and remain on file for at least one (1) week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter, provided however, that the effective date of the proposed contract shall be January 1, 1971.
