HomeMy WebLinkAboutOrdinances Book 17, Page 424, Ordinance Number 71-1-422424; ORDINANCE NO. 71-1-422 AN ORDINANCE REPEALING CHAPTER 6 "BONDSMEN" OF THE CODE OF ORDINANCES CITY OF PADUCAH, KENTUCKY WHEREAS, the Kentucky General Assembly in 1970 adopted House Bill 29 which has been codified in Chapter 304 Sub -title 34 of the Kentucky Revised Statutes to regulate the activities and licensing of bail bondsmen throughout the commonwealth of Kentucky, and WHEREAS, the Board of Commissioners of the City of Paducah has determined that said regulations are an adequate safeguard for people charged with crime in the City of Paducah that must employ the services of a bail bondsman, provided said laws are properly enforced, and WHEREAS, Chapter 6 of the Code of Ordinances of the City of Paducah, Kentucky, provided an attempt by the City of Paducah, Kentucky, to regulate the activities of such bondsmen but would now require extensive litigation to determine all areas in which the city ordinance was in conflict with the state statute and not merely in addition to or not inconsistent with said statute, and WHEREAS, bail bondsmen will continue to be licensed by the City of Paducah for purposes of engaging in business within the city pursuant to Section 17-70 of the said Code of Ordinances, and WHEREAS, Kentucky Revised Statutes 304 Sub -title 34 is now in full force and effect, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Chapter 6 "Bondsmen" of the Code of Ordinances City of Paducah, Kentucky, be, and the same is hereby, repealed in its entirety, said Chapter 6 being codified from an ordinance adopted July 13, 1965. SECTION 2. This ordinance shall be in full force and effect from and after its adoption.
