HomeMy WebLinkAboutOrdinances Book 17, Page 361, Ordinance Number 70-11-4023 6'L ORDINANCE NO. 70-11-402 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY ON NORTH 37TH STREET BETWEEN PHILLIPS AVENUE AND MINNICH AVENUE, AND AMENDING THE PADUCAH ZONING ORDINANCE -1961 SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on November 4, 1970, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY ON NORTH 37TH STREET BETWEEN PHILLIPS AVENUE AND MINNISH AVENUE", be adopted as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification change and the map amendment proposed in said resolution be, and the same are hereby declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, changed from R-1 One -family Residential Zone to R-2 One -Family Residential Zone: Beginning at the point of intersection of the center line of 37th Street with the center line of Phillips Avenue; thence in a northerly direction along and with the center line of Phillips Avenue a distance of 199.75 feet, more or less, to the point of intersection of the center line of Phillips Avenue with the north line of Charles Clark, if extended; thence in a westerly direction along and with the north line of Charles Clark a distance of 263.75 feet to Clark's northwest corner; thence at right angles and in a northerly direction a distance of 10 feet, more or less, to the northeast corner of C. E. Shelby; thence with Shelby's north line a distance of 119.5 feet to Chelby's northwest corner; thence at right angles and in a southerly direction a distance of 10 feet, more or less, to a point, Mrs. Harold Brown's northeast corner; thence in a westerly direction with Brown's north line a distance of 144.25 feet, more or less, to the center line of Minnish Avenue; thence in a southerly direction along and with the center line of Minnich Avenue a distance of 199.75 feet, more or less, to its point of intersection with the center line of Lillian Avenue; thence in an easterly direction along and with the center line of Lillian Avenue a distance of 527.5 feet, more or less, to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision 362 hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5.
