HomeMy WebLinkAboutOrdinances Book 17, Page 352, Ordinance Number 70-10-397352/ ORDINANCE NO. 70-10-397 AN ORDINANCE ESTABLISHING THE PADUCAH-McCRACKEN COUNTY RECREATIONAL TOURIST AND CONVENTION COMMISSION, AND AUTHORIZING AND DIRECTING THE MAYOR TO APPOINT THE MEMBERS TO SAID COMMISSION JOINTLY WITH THE McCRACKEN COUNTY JUDGE WHEREAS, the governing bodies of the City of Paducah and the County of McCracken, Kentucky, have jointly agreed to establish a Paducah -McCracken County Recreational Tourist and Convention Commission pursuant to the provisions of KRS 83.340 (2), 83.345 and 83.350, and for the purposes therein contained, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah jointly with the County of McCracken, create and establish the Paducah -McCracken County Recreational Tourist and Convention Commission for the purpose of promoting recreational, convention and tourist activity in the City of Paducah and County of McCracken. SECTION 2. The Paducah -McCracken County Recreational Tourist and Convention Commission shall be composed of seven (7) members, and the Mayor, together with the County Judge, is hereby authorized and directed to appoint said members in the following manner: (a) Two Commissioners from a list submitted by the local city Hotel and Motel Association. (b) One Commissioner from a list submitted by the local county Hotel and Motel Association, provided that if only one local hotel and motel association exists which covers both the city and county, then three commissioners shall be appointed from a list submitted by it, or provided further that if no local hotel or motel association exists, then three commissioners shall be appointed from the list of all hotel and motel owners or managers, with no two commissioners representing the same owner or hotel or motel. (c) One Commissioner from a list submitted by the local Restaurant Association or Associations. (d) One Commissioner from a list submitted by the Chamber of Commerce of the largest city in the county. 353 (e) One commissioner by the Mayor of the largest city in the county. (f) One commissioner by the county judge. SECTION 3. Vacancies shall be filled in the same manner that original appointments are made. SECTION 4. The Commissioners shall be appointed for terms of three years, provided, that in making the initial appointments, the Mayor and County Judge shall appoint two commissioners for a term of three years, two commissioners for a term of four years and three commissioners for a term of one year. SECTION 5. The commission shall elect from its membership a chairman and a treasurer, and may employ such personnel and make such contracts as are necessary to effectively carry out the purposes of KRS 83.340 to 83.350. Such contracts may include but shall not be limited to the procurement of promotional services, advertising services and other services and materials relating to the promotion of tourist and convention business; provided, contracts of the type enumerated shall be made only with persons, organizations and firms with experience and qualifications for providing promotional services and materials such as advertising firms, chambers of commerce, publishers and printers. SECTION 6. The books of the commission shall be auditedby an independent auditor who shall make a report to the commission, to the organization submitting names from which commission members are selected, and to the mayor and the county judge. SECTION 7. The Paducah -McCracken County Recreational Tourist and Convention Commission shall be governed by Kentucky Revised Statutes Sections 83.340, 83.345 and 83.350, as now exists, or as hereafter may be amended, and their powers and duties shall be those granted by said Statutes. Any and all room taxes to be hereafter levied to support the activities of said commission shall be levied on a county wide basis by the Fiscal Court of McCracken County and collected by the County Government. SECTION 8.
