HomeMy WebLinkAboutOrdinances Book 17, Page 238, Ordinance Number 70-7-361238 ORDINANCE NO. 70-7-361 AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING AMONG THE CITY OF PADUCAH, COUNTY OF MCCRACKEN AND THE KENTUCKY DEPARTMENT OF HIGHWAYS FOR A PADUCAH URBAN AREA TRANSPORTATION STUDY BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor be, and he is hereby, authorized and directed to execute, on behalf of the City of Paducah, Kentucky, a Memorandum of Understanding among the City of Paducah, County of McCracken and Kentucky Department of Highways, pertaining to a Paducah Area Transportation Study as has been authorized and approved by the U. S. Bureau of Public Roads, said Memprandum of Understanding to be in words and figures as follows: MEMORANDUM OF UNDERSTANDING Regarding the establishment of the continuing comprehensive transportation planning process in the Paducah -McCracken County area. Pursuant to Title 23, Chapter 1, Section 134 of the United States Code, the duly elected officials of the City of Paducah and McCracken County, hereinafter designated the LOCAL OFFICIALS, the Kentucky Department of Highways, hereinafter designated the STATE, jointly and mutually agree to cooperate and participate in the continuing URBAN TRANSPORTATION PLANNING PROCESS in the Paducah Urban Area . More specifically this will include: 1. The development of a proposed network of traffic - ways to meet changing conditions through 1990 in the Paducah Urban Area. 2. The preparation and dissemination of the pertinent information needed by governing bodies in their consideration of planning proposals and improve- ment programs, and further encouragement of public interest. NOW THEREFORE BE IT MUTUALLY UNDERSTOOD: SECTION 1. Although Paducah does not yet meet the population require- ments stipulated in the 1962 Federal -aid Highway Act, it is in the best interest of both the STATE and LOCAL OFFICIALS to follow the requirements 239 of Section 10, which states that: "After July 1, 1965 . . . . any progxam for projects in any urban area of more than 50,000 population must be based on a continuing comprehensive transportation planning process carried on cooperatively by State and Local Communities in accordance with the pbjectives as stated in this section." It is necessary that appro- priate officials of all legally constituted governing bodies cooperate in the establishment of a planning process. SECTION II. That all signatory parties realize that the comprehensive character of the planning process requires inventories and analysis of the following basic elements: 1. Economic factors affecting development 2. Population 3. Land Use 4. Transportation facilities including those for mass trans- portation 5. Travel patterns 6. Terminal and transfer facilities 7. Traffic control features S. Zoning ordinances, subdivision regulations, building codes, etc. 9. Financial resources 10. Social and community value factors, such as preser- vation of open space, parks and recreational facilities; preservation of historical sites and buildings, environ- mental amenities; and aesthetics. SECTION III. That current data on land use, travel and transportation, and related facilities, be maintained and updated by the appropriate staffs Of STATE and LOCAL OFFICIALS in order to keep abreast of all conditions as they change from those initially analyzed. SECTION IV. That vosts incurred in obtaining these objectives be borne in the following relationships: All costs incurred in connection, dissemi- nation, evaluation, re-evaluation and necessary adjustments in basic elements 4, 5, 6 and 7, as listed above, be the responsibility of the STATE, in cooperation with the U. S. Department of transportation, Bureau of Public Roads; all costs incurred in connection, dissemination, evaluation and reevaluation, and necessary adjustments in basic elements 1, 2, 3, 240 8, 9, and 10, as listed above, be the responsibility of LOCAL OFFICIALS and all costs incurred in utilizing elements 1, 2, 9, and 10, as listed above, in evaluating the transportation system, be the responsibility of the STATE. SECTION V. It is understood that each signatory party to this MEMO- RANDUM OF UNDERSTANDING does jointly and mutually agree to cooperate and participate in the continuing URBAN TRANSPORTATION PLANNING PROCESS in the Paducah Urban Area."
