A RESOLUTION REQUESTING THE AREA DIRECTOR FOR THE DEPARTMENT
OF HOUSING AND URBAN DEVELOPMENT TO RELIEVE THE CITY OF PADUCAH
FROM ALL LIABILITY PURSUANT TO A PLANNING GRANT FOR A WATER TREATMENT
FACILITY, PROJECT NO. P -KY -3124
WHEREAS, the United States of America has heretofore made an
advance, pursuant to an agreement dated November 19, 1968 to the
City of Paducah, Kentucky in the amount of $23,000 for the purpose
of plan preparation of the public work described in the agreement
as a "Water treatment plant", and
WHEREAS, by the use of the Federal advance the City of
Paducah, Kentucky, caused to be prepared plans and specifications
for the public work described in the aforesaid agreement, and
WHEREAS, a substitute facility has been designed and it has
been determined that no part of the plans prepared with the Federal
advance was of current value or could have been used in the design.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Area Director be requested to make a
determination that the City of Paducah, Kentucky be relieved of all
liability under the above mentioned agreement upon no payment
which represents the proportionate amount of the advance relating
to the public works construction in accordance with the plans prepared
with said Federal advance all as more fully certified to by said
architect engineer.
SECTION 2. This resolution is adopted pursuant to authority provided
by KRS 96.350 thru 96.510.
SECTION 3. This resolution shall be in full force and effect from
and after its adoption.
