HomeMy WebLinkAboutOrdinances Book 17, Page 102, Ordinance Number 70-4-311102 / ORDINANCE NO. 70-4-311 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE AMENDMENT OF SECTION 21 OF THE PADUCAH ZONING ORDINANCE -1961, AND AMENDING SAID SECTION BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a Resolution adopted by the Paducah Planning Commission on April 1, 1970, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED AMENDMENT OF SECTION 21 OF THE PADUCAH ZONING ORDINANCE -1961", shall be, and it is hereby, approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That Section 21 of the Paducah Zoning Ordinance -1961, be, and the same is hereby, amended to read as follows: "Section 21 A. New two-family and new multi -family residential structures are special exceptions in the R-1 Zone and are permitted uses in the R-2 and R-3 Zones respectively, subject to the following conditions: "Section 21 A-2 Plans for the proposed construction shall be submitted to and approved by the Commission prior to the issuance of a building permit which plans shall be accompanied by a written statement of an architect registered in the State of Kentucky certifying that such plans comply with the requirements of this section. The procedure for plans in an R-1 Zone shall be the same as above except that a building permit shall not be issued until final approval has been passed by the Board of Adjustment after a duly advertised public hearing. "Section 21 B. Town Houses are special exceptions in the R-1 Zone and are permitted uses in the R-2 and R-3 Zones respectively, subject to the following conditions: "Section 21 B-9 Plans for the proposed construction shall be submitted to and approved by the Planning Commission prior to the issuance of a building permit. The plans shall be accompanied by a written statement from an architect, registered in the State of Kentucky, certifying that the plans comply with the requirements of this ordinance. The procedure for plans in an R-1 Zone shall be the same as above except that a building permit shall not be issued until final approval has been passed by the Board of Adjustment after a duly advertised public hearing." SECTION 3. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all 103 other sections, paragraphs and provisions.
