HomeMy WebLinkAboutOrdinances Book 16, Page 700, No Resolution Number700 A RESOLUTION AUTHORIZING THE CORPORATION COUNSEL TO DEFEND THE CONSTITUTIONALITY OF KRS 96.820 ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY WHEREAS the Electric Plant Board of Glasgow, Kentucky, together with others, has filed a civil action in the Barren Circuit Court attacking the constitutionality of KRS 96.820'as amended in 1968, and WHEREAS the validity of KRS 96.820 is vital to the interest of the City of Paducah, Kentucky, as said statute relates to the in -lieu -of tax payment to be made from the Electric Plant Board of Paducah, Kentucky to the City. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Corporation Counsel be, and he hereby is; authorized to take any legal action appropriate and necessary to protect and defend the constitutionality of KRS 96.820 by such means as, but not limited to, intervention by the City of Paducah, Kentucky as a defendant in the said civil action in the Barren Circuit Court. SECTION 2. This resolution shall be in full force and effect from and after its adoption.
