HomeMy WebLinkAboutOrdinances Book 16, Page 674, Ordinance Number 68-7-90ORDINANCE NO. 68-7-90 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY ON THE NORTHEAST SIDE OF THE BELTLINE HIGHWAY BETWEEN BROWN AND CALDWELL STREETS AND AMENDING THE PADUCAH ZONING ORDINANCE -1961 SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on July 17, 1968, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY ON THE NORTHEAST SIDE OF THE BELTLINE HIGHWAY BETWEEN BROWN AND CALDWELL STREETS," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification change and the map amend- ment proposed in said resolution be, and the same hereby is, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, changed from C-1 Conservancy Zone to B-4 Commercial Zone: 674 Beginning at a northerly highway right-of-way marker, which marker is 19.84 feet east of another highway right-of-way marker at the point where the Beltline Highway serving U.S. Highways 60, 62 and 68 begins to widen for its southerly approach to an overpass of Caldwell Avenue and the N.C. & ST. L. Railroad tracks; thence at an interior angle of 268 degrees 52 minutes 00 seconds as made from the line between the two said highway markers and in a northerly direction 215.95 feet to a highway right-of-way marker, which line marks the existing M-3 and C-1 zone boundary; thence with an interior angle of 88 degrees 34 minutes 00 seconds and easterly 20.57 feet to a highway right-of-way marker; thence with an interior angle of 273 degrees 25 minutes 30 seconds and northerly continuing along the existing M-3 and C-1 zone boundary line, 180.66 feet to a highway right-of-way marker; thence with an interior angle of 94 degrees 10 minutes 00 seconds and easterly 29.07 feet to a highway right-of-way marker; thence continuing easterly leaving the Beltline Highway right-of-way, 280.00 feet to a steel pin, thence with an interior angle of 89 degrees 54 minutes 00 seconds and southerly 500.26 feet to a steel pin; thence with an interior angle of 129 degrees 03 minutes 15 seconds and southerly 379.76 feet to the point of the existing M-1 zone boundary line; thence 285.15 feet to a highway right-of-way marker; thence with an interior angle of 91 degrees 19 minutes 41 seconds and easterly 19.84 feet to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or 675 provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5.
