HomeMy WebLinkAboutOrdinances Book 16, Page 474, Ordinance Number 68-2-19474 ORDINANCE NO. 68-2-19 AN ORDINANCE AUTHORIZING THE PURCHASE OF CERTAIN LAND FROM GUTHRIE MAY AND HIS WIFE, ALICE MAY, FIXING THE PURCHASE PRICE OF SAME, AND PROVIDING FOR THE TERMS AND PROVISIONS OF SUCH PURCHASE WHEREAS, the Board of Commissioners of the City of Paducah heretofore resolved on December 13, 1966, that the City Manager enter into a purchase contract with Guthrie May for the purchase of certain property adjoining Brooks Stadium Park for a total purchase price of $40,000.00 with a deposit of $2,500.00 as earnest money, said purchase contract being conditioned upon said land being approved for an open - space program grant from the United States of America, and WHEREAS said purchase contract was executed between the City and said landowners, and said United States Government has approved an open - space program grant to be applied to the purchase of said property, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, Kentucky purchase from Guthrie May and his wife, Alice May, the following described land in the City of Paducah, Kentucky: Being in the City of Paducah, Kentucky, adjoining property of the City known as Brooks Stadium Park, bounded by same on the north, bounded by Brookhaven Subdivision on the east, bounded by Mississippi Street on the west and bounded by Seitz Street on the south, and being more particularly described by metes and bounds as follows, to -wit: Beginning at the northeast corner of the intersection of Seitz Street and Mississippi or 23rd Street; thence in a northerly direction along the east property line of Mississippi or 23rd Street 724.17 feet; thence at an interior angle of 84 degrees 52 minutes 05 seconds in an easterly direction 186 feet to the east property line of "C" Street; thence with the east property line of "C" Street in a northerly direction 210.10 feet to the line dividing the property of the grantor and Brooks Park; thence in an easterly direction with said dividing line 863 feet, more or less to the northwest corner of Brookhaven Subdivision as recorded in Plat Book "F", page 4, McCracken County Court Clerk's office; thence with the west or side line of Lot 1, Block 5 in Brookhaven Subdivision in a southerly direction 129.02 feet to the north line of 25th Street; thence crossing 25th Street and continuing in a southerly direction with the west or rear lines of Lots 1 and 2, Block 6 in Brookhaven Subdivision 185.71 feet; thence continuing in a southerly direction with the west or rear lines of Lots 3 and 4, Block 6 in Brookhaven Subdivision 136.0 feet; thence continuing in a southerly direction with the west or rear lines of Lots 5 and 6, Block 6 in Brookhaven Subdivision, 205.7 feet; thence in a south- easterly direction with the southwesterly or rear lines of Lots 6 and 7, Block 6, Brookhaven Subdivision, 166.25 feet; thence in a southerly direction with the westerly or side 47 line of Lot 11, Block 6, Brookhaven Subdivision 159.22 feet to the northerly line of Seitz Street; thence in a westerly direction with the northerly line of Seitz Street 992.68 feet to the point of beginning. There is excepted from the above conveyance a strip of ground 60 feet in width across the northerly portion of the above described property known as 25th Street conveyed by the grantor to the City of Paducah, in Deed Book 395, page 447, said tract, exclusive of 25th Street, being 17.6 acres, more or less. Being a part of the same land conveyed to Guthrie May by Mrs. Anna Schmidt, et al, by deed dated June 16, 1951 and of record in Deed Book 303, page 184, McCracken County Court Clerk's office. The purchase price to be paid for same shall be the the sum of $40,000.00, less and except the amount of $2,500.00 heretofore paid as earnest money, and upon receipt of a general. warranty deed conveying said land to the City of Paducah, and approved by the Corporation Counsel, the City Treasurer is hereby authorized and directed to pay to the said Guthrie May and his wife, Alice May, the sum of $37,500.00. SECTION 2. This ordinance shall be introduced and remain on file for public inspection for at least one (1) week in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter.
