OF ELIZABETHTOWN, KENTUCKY, IN THE TOTAL AMOUNT OF $1,110,052.3? (BASE BIDS A) FOR THE CONSTRUCTION OF PROJECTS 1 AND 2 OF CONTRACT NO. 1 RELIEF SEWERS (HUD PROJECT NO. WS -3-18-0003); AUTHORIZING THE CITY MANAGER TO EXECUTE ON BEHALF OF SAID CITY, A CONTRACT FOR SUCH CONSTRUCTION, AND PRESCRIBING THE TERInS AND CONDITIONS OF SUCH CONTRACT BE IT ORDAINED BY THE BOARD OF COMIMISSIONERS OF THE CITY OF PADUCAH, Y.ENTUCKY: SECTION 1. That the City of Paducah, Kentucky, subject to the conditions hereinafter set out, accept the combined and discounted bids of Dyer and Dyer, Inc., of Elizabethtown, Kentucky, in the total amount of 4'1,110,052.37 ($381,F'76.11 and $728,176.26), (Base Bids A) for the construction of Proiects 1 and 2 of Contract No. 1, Relief Sewers (HUD Proiect No. WS -3-18-0003) subject to all the terms and conditions contained in the documents on which said bidder based its bid for construction, such documents having been prepared by Burns and icDonnell Engineerinr Companv of Kansas City, Missouri, entitled "Invitation to Bid, Specifications, Proposal, Contract and Bond Form, Contract No. 1 - Relief Sewers, HUD Project iso. VIS-3-18-0003"- SECTION-2.. IS-3-18-0003".SECTION2. Acceptance of the•bid of the said Dyer and Dyer, Inc. as set out in Section 1 hereof, is and shall he subject to the following conditions and provisions: A. Froper execution of all contract documents by the bidder. B. Sale by the City of Paducah of the general obligation bonds in the smount of $2,500,000.00 authorized by the voters of said city at the general election in November, 1965, and receipt of the proceeds Froin such sale. C. Approval of the contract award by the Department of Housing and Urban De,,elopment. D. Receopt from Illinois Central Railroad Company of necessary agreements .for the construction and maintenance of the sewers in said Frr�tect pertinent to its properties. SECTION 3. Upon the appro-al of the Corporation Counsel of all documents and matters in connection herewitl-, the City Manager is hereh— authorized and directed to execute the necessary contract :-pith the aforesaid tidder upon the .forms pro-ided by the aforesaid Burns and McDonnell Enrrineerinr• Companv. SECTION h . All sums of monev to '.e paid to the said bidder for tl-e construction pro,+ided for herein shall he pa -id from funds derived from the sale of the foregoing 4:2,500,000.00 general obliration bond issue, and from the aforesaid HUD Prosect. 41 SECTION 5.
