HomeMy WebLinkAboutOrdinances Book 16, Page 332, No Ordinance Number332 AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE CITY OF PADUCAH, KENTUCKY AND THE ANGELS OF MERCY, INCORPORATED PRO- VIDING FOR EMERGENCY AMBULANCE SERVICE FOR THE CITY OF PADUCAH, AND PROVIDING COMPENSATION THEREFOR BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah enter into a contract with Angels of Mercy, Incorporated for the latter to provide emergency ambulance service to the City of Paducah in accordance with the con- tract set out below, and that the City Manager be, and he is hereby, authorized to execute, on behalf of the City of Paducah an agreement in words and figures as follows: "CONTRACT "THIS CONTRACT made and entered into this the day of September, 1967, by and between the CITY OF PADUCAH, KENTUCKY, hereinafter referred to as the City, and the ANGELS OF MERCY, INCORPORATED, of Paducah, Kentucky, hereinafter referred to as the party of the second part; "W I T N E S S E T H i "WHEREAS, the party of the second part operates a 24 hour ambulance service in the City of Paducah, and, "WHEREAS, the City, by and through its Police and Fire Depart- ments and other emergency services, including rescue, auxiliary police and firemen and civil defense when in service, is re- quired to place emergency calls for ambulance service in the event of injuries resulting' -from automobile accidents, fires assaults and other similar causes or public catastrophes and in the event of some illnesses occurring in public places within the City, "NOW THEREFORE, it is agreed by and between the parties as follows, to -wit: I. "Party of the second part will maintain and provide to the City of Paducah, Kentucky, a 24 hour emergency service, and the said party of the second part will provide services and equipment according to good standards and practices recognized by the 333 American College of Surgeons Committee on Trauma. The party of the second part will respond with its own equipment at the clos- est location to the scene of the incident to all calls placed by law enforcement or official emergency agencies or agents of the City. II. "The City agrees to furnish the second party with a list of employees and members of its emergency departments and agencies and to keep said list current and correct. III. "The City will compensate party of the second part for such 24 hour service for a monthly compensation in a flat amount of $300.00, payable on or before the 15th day of each month. IV. The party of the second part shall have the right to collect from the person to whom the service is rendered, if it is possible for this to be done, but in no event shall the City be required to reimburse party of the second part onany individual occasion other than to pay the $300.,00 per month to the party of the second part. V. "Party of the second part agrees to obtain and keep in full force and effect at all times covered by this agreement, a policy of liability insurance on each ambulance, which policy of insurance shall be properly endorsed so as to show the City of Paducah as a name insured, and such policy shall have minimum limits of not less than $100,000 $300,000 for personal injury, and $20,000 for property damage, and party of the second part will furnish a certificate of insurance or other evidence of coverage to the City. The second party is an independent contractor and in noway an agent of the City, and it agrees to defend and save harmless the City in any action against the City arising out of this contract. VI. "Party of the second part agrees that it will pay its occupational license taxes and that it will otherwise abide by all other applicable statutes and ordinances now in effect, or which may 334 hereafter be enacted. VII. "This contract is and shall be deemed to be a contract for a period .of six months, or longer, and continuing thereafter, and may not be cancelled or terminated without giving written notice by either party for a period of six months, and the notice of termination given either by personal delivery or depositing such notice in the United States mail, postage prepaid. VIII. "Upon the execution of this Agreement all prior contracts be- tween the parties shall become null and void, except for any indebtedness owing from the City to the second party for uncompensated services from previous month, and the effective date for this contract shall be the first day of month in which it is executed. This ordinance shall be introduced and remain on file for at least one week for public inspection in the completed form in which it shall be put upon its final passage and said ordinance shall be in full force and effect ten (10) days from and after its adoption.
