HomeMy WebLinkAboutOrdinances Book 16, Page 322, No Ordinance Number322 i AN ORDINANCE CREATING AND ESTABLISHING THE PADUCAH-MCCRACKEN COUNTY RIVERPORT AUTHORITY AND PROVIDING FOR THE APPOINTMENT OF MENBERS THEREOF AND DELEGATING POWERS THERETO WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, finds and declares that it is to the best interest of the public to promote and develop river navigation facilities, river transportation, riverport facilities, and to attract industrial or commercial operations in connection therewith, and WHEREAS, the Fiscal Court of the County of McCracken is contemplating and expected to pass a resolution joining it with the City in creating a joint riverport authority, and WHEREAS, R. R. S. 65.510 et sea. provide for a City and county, acting jointly, or a city acting separately, to create a riverport authority to accomplish the foregoing purposes. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. There is hereby created and established, pursuant to K. R. S. 65.510 et sea. "The Paducah -McCracken County Riverport Authority". SECTION 2. Said riverport authority shall be composed of six (6) members, three (3) of whom shall be appointed by the Mayor of the City of Paducah, and three (3) shall be appointed by the County Judge of McCracken County. Of the initial appointments the Mayor and County Judge shall each appoint one member for two (2) years, one member for three (3) years, and one member for four (4) years. SECTION 3. Appointments made by the Mayor shall be with the approval of the Board of Commissioners. SECTION 4. All members appointed shall reside within McCracken County and each shall have knowledge or experience in matters relating to river transportation or riverport facilities. No riverport authority member shall hold any official office with the City of Paducah, or the County of McCracken. SECTION 5. The Paducah -McCracken County Riverport Authority herein established shall have all powers, functions, and duties authorized by the Kentucky Revised Statutes, and in addition thereto, 323 the City of Paducah, hereby delegates such other powers to the river - port authority which are necessary in carrying out its operations and activities. SECTION 6. Each section, paragraph or provision of this ordinance is hereby declared to be separate from every other section, paragraph or provision herein and should any section, paragraph, or provision hereof be held invalid at any time it shall have no effect upon the validity of every other remaining section, paragraph or provision hereof. SECTION 7. This ordinance shall be in full force and effect from and after its adoption.
