HomeMy WebLinkAboutOrdinances Book 16, Page 223, No Ordinance Number223 I'll' AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A CONTRACT BETWEEN THE KENTUCKY DEPARTMENT OF COMMERCE AND THE CITY OF PADUCAH, KENTUCKY, PROVIDING FOR TECHNICAL PLANNING ASSISTANCE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor be, and he is hereby authorized and directed to execute a contract between the Kentucky Department of Commerce and the City of Paducah, Kentucky, providing for technical planning assistance, in words and figures as follows: "This agreement, made and entered into this day of 1967, by and between the Kentucky Department of Commerce (hereinafter referred to as the Department), an agency of the Commonwealth of Kentucky and the City of Paducah, Kentucky (hereinafter referred to as the City). WITNESSETH: WHEREAS, the Department desires to cooperate with the City in every way possible to the end that a constructive planning program may be initiated for the improvement and development of the City, `and WHEREAS, it is believed that a cooperative agreement between the Department and the City for the purpose of carrying on a planning program will make available the technical assistance necessary to the City in fulfilling its duties, and WHEREAS, the City has requested that the Department provide such technical assistance, NOW THEREFORE, in consideration of the covenants hereinafter set forth the parties hereto agree as follows: 1. Employment of Department. The City hereby agrees to engage the Department and.'the Department agrees to perform the services here- inafter set forth. 2. Scope of Service. The Department shall perform the following services. a. Meet with the -)Planning Commission while studies are in preparation for the purpose of reporting on the progress of work and consulting with the Commission for advice and recommendations regarding plan proposals. b. Prepare Public Improvements Program (revision) c. Prepare zoning ordinance (revision) d. Prepare capital improvements budget 224 e. Prepare neighborhood analysis (revision) f. Prepare subdivision regulations (revision) 3. Time and Performance. The services of the Department are to commence as soon as practicable after execution of this agreement and shall be undertaken in such sequence as to assure their expeditious completion in the light of the purpose of this agreement, but in any event all of the services required hereunder shall be completed by April 18, 1969. 4. Compensation. For the purpose of providing a portion of the funds necessary to carry out the provisions of this Agreement, IT IS AGREED that the City will pay to the Department the sum of 13,000.00 due and payable as follows: Execution of Agreement $2,600.00 1. November 1, 1967 2,600.00 2. March 1, 1968 2,600.00 3. November 1, 1968 2,600.00 4. February 1, 1969 2,600.00 5. Termination of Agreement. Either party may terminate this agreement prior to the expiration date set forth in paragraph 3 by giving notice to the other party specifying the date of termination, such notice to be given not less than thirty (30) days prior to the termination date therein specified. The Department may terminate this agreement without notice to the City at any time the City becomes sixty (60) or more days delinquent in payments pursuant to the payment schedule set out in paragraph 4 above. In the event that this agreement is terminated, as herein provided, the obligation of the Department to conduct or carry on the work, studies, research, and investigations hereinbefore provided for shall forthwith cease; provided, however, that if the City initiates action to terminate this agreement as therein provided, the Department, upon receipt of notice to terminate, shall have the option of completing those studies which, in the opinion of the Department, are more than fifty percent complete on the date of and receipt of notice to terminate,/shall be entitled to receive com- pensation for preparation of such studies as provided in paragraph 6. If such option is exercised, the Department shall so notify the City in writing prior to the date of termination specified in the notice to terminate. 225 6. Compensation in Event of Termination. Upon termination of this agreement pursuant to paragraph 5 the City shall pay the Department for that proportion of the total payment which the services rendered including extension of services pursuant to paragraph 5 bears to the total services herein provided. Any funds paid to the Department in excess of the applicable proportionate payment shall be refunded to the City by the Department. 7. Authorized Representatives. In all matters relating to the carrying out of this agreement, the Commissioner of the Department shall act for the Department and the Mayor for the City. IN WITNESS THEREOF the parties have caused this instrument to be executed by their representatives thereunto duly authorized as of the day and year written above. This ordinance shall be introduced and remain on file for at least one (1) week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) daus thereafter.
