HomeMy WebLinkAboutOrdinances Book 16, Page 221, No Resolution Number221 A RESOLUTION AUTHORIZING THE ELECTRIC PLANT BOARD OF THE CITY OF PADUCAH, KENTUCKY TO CONSTRUCT ELECTRIC POWER TRANSMISSION LINES OVER, ALONG AND UNDER ANY STREET OR ALLEY NOW OR HEREAFTER DEDICATED, WHETHER OR NOT SAID LAND HAS BEEN ACCEPTED BY THE CITY FOR IMPROVEMENT OR MAINTENANCE WHEREAS, on July 20, 1965 the City adopted a Resolution permitting the Electric Plant Board of the City of Paducah, Kentucky to exercise the powers granted in KRS 96.570 (4) and to construct lines and facilities across, along and under any street or public highway, and over any lands which are now or may be property of the City, and WHEREAS, various lands have been heretofore granted or dedi- cated by deed or plat to said City for streets and alleys, and WHEREAS, some of said lands have not been accepted by the City for improvements or maintenance, but have not been closed or returned to the grantor or adjoining land owners, and WHEREAS, the Electric Plant Board desires a special permission to construct electric power transmission lines over, along and under said unaccepted and unimproved streets and alleys, NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Electric Plant Board of the City of Paducah, Kentucky be, and it is hereby, authorized and permitted to construct, operate and maintain electric power transmission and distribution lines and appurtenances over, along and under any street and alley now or hereafter dedicated to the City, whether or not said land has been accepted by the City for improvement or maintenance. SECTION 2. This Resolution shall not constitute an acceptance for improvement or maintenance by the City of Paducah any land now or hereafter conveyed or dedicated to the City for a street or alley, which land is not otherwise developed by the City. SECTION 3. This Resolution shall be supplementary to that adopted by this Board on July 20, 1965, which shall continue and remain in full force and effect. SECTION 4.
