HomeMy WebLinkAboutOrdinances Book 16, Page 22, No Resolution NumberA RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY, AN AGREEMENT I^LITH ILLINOIS CENTRAL RAILROAD COMPANY GRANTING PERMISSION TO SAID CITY TO CONSTRUCT AND MAINTAIN CERTAIN CONCRETE STORM SEWER PIPE LINES AND CONCRETE BOX CULVERT STORM SEWERS UNDER TRACKS AND PROPERTY OF SAID RAILROAD COPIPAVY BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FADUCAH KENTUCKY: SECTION 1. That the Mayor and City Clerk be, and they are hereby, authorized and directed, on behalf of the City of Paducah, Kentucky to execute an apreement with Illinois Central Railroad Company granting permission to the City to construct and maintain a 72 -inch reinforced concrete storm sewer pipe line underneath its tracks and property between Broadwav and Kentucky Avenue and between 11th Street (if extended) and 12th Street, a 7 -foot wide by 7 -foot 5 -inch concrete box culvert storm sewer on said Railroad Company's property south of Kentucky Avenue, and a-hA-inch reinforced concrete storm sewer pipe line on said Railroad Company's property between the south line of Tennessee Street and Bradshaw Creek, said construction and maintenance, and said -rant of permission therefor, to be in accordance with and subject to all the terms and conditions of said agreement, a copy of which is attached hereto and dated -the 7th day of September, 1966, all of the terms, conditions and provisions of said agreement beim hereby approved and ratified. SECTION 2. The agreement referred to in Section 1 above is the same agreement as the one referred to in the Resolution adopted by the Board of Commissioners on December 13, 1966, and recorded in Ordinance Book 15, page 110, except that said agreement has been revised in certain respects, and this Resolution supersedes the above mentioned Resolution. SECTION 3. A certified copy of this Resolution shall be transmitted to Illinois Central Railroad Company. SECTION 4;. This Resolution shall be in full force and effect from and after its adoption.
