HomeMy WebLinkAboutOrdinances Book 16, Page 169, No Ordinance Number168 AN ORDINANCE AUTHORIZING THE PURCHASE OF A PERMANENT AND A TEMPORARY EASEMENT FOR SEWER PURPOSES OVER CERTAIN PROPERTY OF JAMES R. REEVES AND WIFE, MARGARET REEVES BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah purchase a permanent easement and a temporary construction easement for sewer purposes from James R. Reeves and wife, Margaret Reeves, over the following described property in the City of Paducah: PERMANENT EASEMENT Being a triangular strip of ground described as follows: Beginning at the southeast corner of the intersection of the Beltline Highway (Coxey Street) and the Old Mayfield Road; thence in a southerly direction along the east property line of the Old Mayfield Road 65.0 feet; thence in a northeasterly direction 73.69 feet to the south property line of the Beltline Highway (Coxey Street); thence in a westerly direction and along the south property line of said highway or street a distance of 55 feet to the point of beginning. TEMPORARY CONSTRUCTION EASEMENT A strip of ground 25 feet in width lying east of and adjacent to the east line of above described permanent easement, extending from the Old Mayfield Road to the Beltline Highway (Coxey Street). SECTION 2. The purchase price for the easements mentioned in Section 1 hereof shall be the sum of $1,500.00, and upon receipt of an easement executed by James R. Reeves and wife, Margaret Reeves and approved by the Corporation Counsel, the Acting City Treasurer is hereby authorized and directed to deliver and pay to the said James R. Reeves and wife, Margaret Reeves the amount of $1,500.00, to be charged to and paid from the Storm Sewer Construc- tion Account, and as a further consideration for the conveyance of the easements described in Section 1, hereof the City will install a 30 foot curb cut beginning as near as practicable to the southerly end of the above described permanent easement fronting on the Old Mayfield Road, and the City, at its expense, shall also lower the brick wall now existing along the sidewalk parallel to the Old Mayfield Road, and the wall shall be lowered to the lowest level considered safe for all purposes by the City Engineer.
