HomeMy WebLinkAboutOrdinances Book 16, Page 120, No Ordinance Number120j AN ORDINAi\C E EXTENDINn THE BOUNDARY OF THE CITY OF PADUCAH, FENTUCKY,BY ANNEXING CERTAIN FROPERTY LYINn ADJACENT TO THE NORTHWEST CORPORATE LIMITS OF SAID CITY, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN SAID.CORPORATE LIMITS 7/HEREAS under an ordinance adopted October 1P, 1966 the Cit" of Faducah, Kentuckv, h- and through its Board of Commissioners, proposed to extend the boundary of the City by annexing certain property lvinr ad4acent to the northwest corporate limits of said City, which property is 'hereinafter more particularly described, and ,9HEREAS said ordinance proposing such annexation and declaring the desirability and necessity of same was published in the Sun Democrat, a newspaper pu'r,lisbed and distril,uted in the Citv of Paducah, FFentucky, as provided and renuired 1v Section 1,24.130 of 1'entucky Revised Statutes, and JHEREAS,said ordinance pro,•ided that notice was given under the provisions of Section P1.110 of Tentuckv Revised Statutes that one or more residents or freeholders of such territor,r proposed to be annexed mav, within tF,irty (30) days after the enactment of said ordinance, file a petition in the Circuit Court of McCracken County, Kentucky, setting forth the reasons why said territory, or an- part of it, should not be annexed, and WHEREAS within said thirty (30) day period there was filed in McCracken Circuit Court a petition of remonstrance by 0. Leon Higdon and other residents and freeholders in said territory in an action known as 1-IcCracken Circuit Court Civil Action No. 7807, 0. Leon Higdon at al Plaintiffs, vs. Citv of Paducah, Kentucky, Defendant, and WHEREAS heretofore and on Mav 1, 1967, by agreement of plaintiffs and defendant in said action, such action was dismissed wiih prejudice to plaintiffs, and such Order of Dismissal provided that the annexation of said territory shall take place notwithstandin:- such action in all respects as if the same had not been filed, and WHEREAS a certified copv of such Order of Dismissal has been recei-ed and filed by said Poard of Commissioners. FOIXT THEREFORE, BE IT CRDAINED BY THE BOARD OF COPUMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the hereinafter described property lying ad;acent to the northwest corporate limits of the City of Paducah, Ifentuckv, he annexed to said Citv, the same beinrr more particularly and accurately descriFed as follows: 121 Bef-inning at a point in the present city limits line said point beim* where the south line of Country Club Terrace Addition, recorded in Plat Book 11011, page 19, McCracken County Court Clerk's Office, intersects the west line of Primrose Place; thence in a southerly direction and along the west line of Primrose Place 252.93 feet to the line dividing the properties of Paxton and Washburn and Abell; thence in a westerly direction along said dividing line 271 feet; thence at an interior angle of 101 degrees 50 minutes in a southwesterly direction 224.70 feet; thence at an interior angle of 188 degrees 03 minutes in a south- westerly direction 180.0 feet; thence at an interior angle of 163 degrees 41 minutes in a southwesterly direction 226.03 feet; thence at an interior angle of 145 degrees 00 minutes in a southerly direction 80.85 feet; thence at an interior an7le of 221 degrees 57 minutes in a southwesterly direction 283.0 feet to the east line of Friedman Avenue; thence at an interior angle of 188 degrees 39 minutes in a southwesterly direction 40 feet to the west line of Friedman Avenue; thence in a southerly direction and with the west line of Friedman Avenue 770 feet more or less tb the present city limits and the north line of the Pines Road if extended west across Friedman Lane from the east; thence in an easterly direction with the present city limits and with said north line of Pines Road 40 feet to the east line of Friedman Avenue; thence in a northerly direction with the present city limits and the east line of Friedman Avenue 143.7 feet; thence with the present city limits and said city limits extended parallel with the Pines Road in an easterly direction 303.22 feet to the west line of Windsor Court; thence in a southerly direction with the west line of Windsor Court 143.75 feet to the north line of the Pines Road and the present city limits; thence with the north line of the Pines Road in an easterly direction with the present city limits 210.0 feet; thence at right angles in a northerly direction and with the present city limits 120.0 feet; thence at a deflection angle to the right of 77 degrees 24 minutes in an easterly direction and with the present city limits 136.32 feet; thence at right angles in a southerly direction and with the present city limits line 153.43 feet to the Pines Road; thence with the north line of the Pines Road in an easterly direction and with the present city limits 350.04 feet; thence at an interior angle of 90 degrees 03 minutes in a northerly direction and with the present city limits 128.0 feet; thence at an interior angle of 86 degrees 50 minutes with the present city limits in a westerly direction 151.16 feet to the east line of Woodland Drive; thence in a northerly direction with the east line of Woodland Drive and with the present city limits 200 feet; thence at right angles in an easterly direction, with the present city limits 264.11 feet; thence at a deflection angle to the left of 56 degrees 37 minutes in a northerly direction with the present city limits 55.6 feet; thence at a deflection angle to the left of 49 deprees 52 minutes in a northwesterly direction and with the present city limits 274.0 feet; thence at a deflection angle to the right of 89 degrees 57 minutes 06 seconds in a northeasterly direction and with the present city limits 2L5.76 feet; thence at an interior angle of 89 degrees 26 minutes 37 seconds in a westerly direction and with the present city limits 95.26 feet to the point of beginning.
