HomeMy WebLinkAboutOrdinances Book 16, Page 1013, Ordinance Number 69-5-206101 ORDINANCE NO. 69-5-206 AN ORDINANCE AMENDING SECTION 17 OF AN ORDINANCE ENTITLED "AN ORDINANCE RELATING TO THE REGULATING AND GRANTING OF LICENSE FOR SELLING, DISPENSING, MANUFACTURING AND DEALING IN ALCOHOLIC AND MALT BEVERAGES IN THE CITY OF PADUCAH, KENTUCKY, UNDER AND PURSUANT TO AN ACT OF THE GENERAL ASSEMBLY OF THE COMMONWEALTH OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IN 1938, KNOWN AS THE 'ALCOHOLIC BEVERAGE CONTROL LAW', REGULATING THE BUSINESS OF SELLING AT RETAIL WHISKEY, WINE, BEER AND OTHER ALCOHOLIC AND MALT BEVERAGES; PROVIDING FOR THE CREATION OF A CITY ALCOHOLIC BEVERAGE ADMINISTRATOR TO BE APPOINTED BY THE CITY MANAGER, TO ADMINISTER AND ENFORCE THE PROVISIONS HEREOF FOR THE CITY OF PADUCAH; PROVIDING FOR THE PUNISHMENT FOR THE VIOLATION OF THE PROVISIONS HEREOF; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH", WHICH WAS ADOPTED BY THE BOARD OF COMMISSIONERS ON MAY 14, 1940, AND LAST AMENDED ON JULY 20, 1948 BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 17 of an ordinance containing the title quoted above, which was adopted by the Board of Commissioners on May 14, 1940, and last amended on July 20, 1948, be, and the same is hereby, amended so that said section as amended shall read as follows: "SECTION 17. No premises for which there has been granted a license for the sale at retail of alcoholic liquor or beverages shall be permitted to remain open for any purpose between the hours of 12:00 o'clock midnight and 8:00 o'clock A.M. on any week day, or at anytime during the twenty-four hours of a Sunday, or until the time for closing of the polls on any election day, and no premises for which there has been granted a license for the sale at retail of malt beverages and beer shall be permitted to remain open for any purpose between the hours of 12:00 o/clock midnight and 6:00 o'clock A.M. on any week day, or at any time during the twenty-four hours of a Sunday, or until the time for closing of polls on any election day. Provided, however, that if a licensee provides a separate department within his licensed premises capable of being locked and closed off, within which is kept all stocks of alcoholic liquor or malt beverages, including beer, and all fixtures and 1014 apparatus connected with his business as such licensee, and said department is kept locked during the times mentioned above, he shall be deemed to have complied with this section. Provided further, however, that during any period in which daylight saving time is in effect in the City of Paducah, retail establishments licensed for the sale of alcoholic or malt beverages for on -premises consumption may remain open until 1:00 o,'clock A.M. on any day, except that no such establishment shall be open between 1:00 A.M. Sunday and the lawful time for opening on Monday morning." SECTION 2. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 3.
