HomeMy WebLinkAboutOrdinances Book 15, Page 977, No Ordinance Number977 / AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH-McCRACKEN COUNTY PLANNING COMMISSION RESPECTING THE AMENDMENT OF SECTION 6 AND SECTION 14 OF THE PADUCAH ZONING ORDINANCE -1961, AND AMENDING SAID SECTIONS BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH; KENTUCKY: SECTION 1. That a Resolution adopted by the Paducah -McCracken County Planning Commission on June 14, 1966, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH-McCRACKEN COUNTY PLANNING COMMISSION ON THE PROPOSED AMENDMENT OF SECTION 6 AND SECTION 14 OF THE PADUCAH ZONING ORDINANCE -196111, shall be, and it is hereby, approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That Section 6 of the Paducah Zoning Ordinance -1961 (Ordinance Book 16, page 507) shall be, and it is hereby, amended to read as follows: "S 6. Continuance of Nonconforming Buildings or Uses. A. Nonconforming Buildings or Structures 1. Maintenance Permitted - A nonconforming building or structure may be maintained, except as otherwise provided in'this Section. 2. Repairs and Alterations - May be made to a noncon- forming building or structure. 3. Additions, Enlargements or Moving (a) A building or structure nonconforming as to regulations for lot area per dwelling unit shall not be added to or enlarged in any manner unless such building or structure, including such addition and enlargement, is made to conform to the lot area per dwelling unit regulations of the zone in which it is located. (b) A building or structure nonconforming as to height or yard regulations shall not be added to or en- larged in any manner unless such building or structure, including such addition and enlargement, is made to conform to all the regulations of the zone in which it is located. (c) No nonconforming building or structure shall be moved in whole or in part to any other location on the lot on which it is situated unless every portion of such building or structure is made to conform to all the regulations of the zone in which it is located. (d) A building or structure nonconforming as to use regulations may not be added to or enlarged. B. Nonconforming Uses of Buildings or Structures 1. Continuation and Chan a of Use - Except as otherwise provided in this Se :E (a) The nonconforming use of a building or structure lawfully existing at the time this ordinance became effective, may be continued. (b) With the forman authorization of the Board, granted after a public hearing duly advertised and conduct- ed in accordance with the provisions of Section 40 hereof, and after a determination that properties in the general vicinity will not be prejudicially 978 affected, a nonconforming use of a building or structure may be changed to a new nonconforming use in the same or a more restrictive zone classifica- tion (e.g., a nonconforming B-1 zone use in an R-1 Zone may, with Board authorization, be changed to another B-1 zone use, or to an R-4, R-3, or R-2 zone use). 2. Expansion Prohibited - A nonconforming use of a building ing or structure desiFned for a conforming use shall not be expanded or extended into any other portion of such conforming buildinP or structure." SECTION 3. That Section 14 of said Paducah Zoning Ordinance -1961 shall be, and it is hereby, amended to read as follows: "S 14. Establishment of Zones: For the purpose of this Ordinance the City of aducah is hereby divided into fourteen (14) Zones, designated as follows: C-1 Conservancy Zone R-1 One -Family Zone R-2 One -Family Zone R-3 Two -Family Zone R-4 Multiple Dwelling Zone B-1 Neighborhood Business Zone B-2 Downtown Business Zone B-3 General Business Zone B-4 Commercial Zone B-5 Shopping Center Zone B-6 Civic Center Zone M-1 General Industrial Zone M-2 Industrial Zone M-3 Heavy Industrial Zone The above zones and the boundaries of such zones are hereby established as shown on the map entitled "City of Paducah -Planning Area -Zone Map", dated 1961, consisting of one sheet and identified by the Signatures of the Chairman of the Commission.and the Mayor of the City, duly attested by the Clerk of the City, which map accompanies this ordinance and is on file in the office of the Commission. Said map and all explanatory matter thereon are hereby adopted and made a part of this ordinance, and a copy thereof shall be filed of record in the office of the Clerk of the McCracken County Court. Upon annexation of new areas to the City of Paducah, such areas shall automatically be classified and zoned according to the plan shown on said map, until such time as this ordinance may be amended to provide otherwise. Said map may be amended and the boundaries of the said zones may be changed in the manner provided by law, through the use of descrip- tions of new zone boundaries, rather than by the adoption of a map or an amended map showing such changes and amendments." SECTION 4. That if any section, paragraph or provision of this ordinan shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions.
