HomeMy WebLinkAboutOrdinances Book 15, Page 955, No Resolution Number955 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE TO PADUCAH MARINE WAYS, INC. A LEASE TO CERTAIN SPACE BETWEEN KENTUCKY AVENUE AND WASHINGTON STREET, THE FLOODWALL AND THE TENNESSEE RIVER BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor and City Clerk of the City of Paducah, Kentucky, be, and they are hereby, authorized and directed to execute, on behalf of the City a lease to Paducah Marine Ways, Inc. in words and figures as follows: "THIS LEASE made and entered into on this the 11th day of May, 1966, by and between CITY OF PADUCAH, KENTUCKY, a municipal corporation of the second class, hereinafter called "Lessor", and PADUCAH MARINE WAYS, INC., a corporation or7anized and existing under the laws of the State of Delaware, having an office and place of business in Paducah, Kentucky, hereinafter called "Lessee". W I T N E S S E T H: THAT for and in consideration of the sum of One Hundred ($100.00) Dollars per month, and subject to the hereinafter terms and conditions, the Lessor does hereby lease to the Lessee certain land in said City described as follows: Being all that portion of Lore 13, 14, 15, 16, 17 and 1$ in Block 3 of "Old Town" that is situated between Kentucky Avenue and Washington Street, the Tennessee RiVer and a line running parallel with the Floodwall and situated 25 feet on the river side of same from its center line." The terms of this lease shall be for a period of five (5) years from the date hereof, and, at the option of the Lessee may be renewed for a period of five (5) additional years. This lease is subject to the following terms and conditions: (a) The leased premises shall not be underlet, or the term, in whole or in part, assip•ned, transferred or set over by the act of the Lessee without being approved by official action of the Board of Commissioners of said City. (b) The Lessor at all times shall have the right to go on said premises at any time for the purpose of checking, repairing or any other action needed in connection with a sewer line running across the same. 956 (c) It is the intention of the Lessor that the Lessee shall have full and complete and peaceable possession of the premises for the term set out herein, however, should this lease be cancelled and Held for naught by operation of law, the Lessor shall not be liable to the Lessee for any damages by reason of such termination. The execution of this lease by the Lessor is authorized by a Resolution adopted by the Board of Commissioners of the City of Paducah, Kentucky on the 10th day of May, 1966.
