HomeMy WebLinkAboutOrdinances Book 15, Page 757, No Resolution Number757 r A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY, A CERTAIN AGREEMENT OF COMPLIANCE BETWEEN THE URBAN RENEWAL AND COMMUNITY DEVELOPMENT AGENCY OF PADUCAH, KENTUCKY, AND SAID CITY BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1_ That the Mayor and City Clerk be, acid they are hereby, authorized and directed to execute, on behalf of the City of Paducah, Kentucky, an Agreement of Com=pliance between the Urban Renewal and Community Develonment Agency of Paducah, Kentucky, and said City, which is in words and figures substantially as follows: "A GREE Bi E N T OF COMPLIANCE "This AGREEMENT OF COMPLIANCE entered into as of the day of 1965 by and between the URBAN RENEWAL AND COMMUNITY DEVELOPMENT AGENCY of Paducah, Kentucky, (hereinafter referred to as 'Agency'), and the CITY OF PADUCAH, KENTUCKY (hereinafter re- ferred to as 'City'); WITNESSETH: "WHEREAS the Agency has adonted an Urban Renewal Plan known as Downtown Civic Center, Project Kentucky R-30, which has been concurred in and annroved by the City, and, "WHEREAS the City is the owner of a certain parcel of real nronerty and improvements thereon within the above referred to Project, which Dronerty is described therein as Parcel 9 in Block 1 and also known as 219 South Third Street, and, "WHEREAS under the terms and conditions of the aforesaid Urban Renewal Plan the above referred to nrooerty is designated as NTBA (Not To Be Acquired) since the imnrovements thereon in their nresent condition meets all requirements of the Urban Renewal Plan, and, "WHEREAS the completion of the Urban Renewal Plan will result in benefits to said City as nrovided in the Plan without the fore- going parcel being acquired by the Agency; "NOW THEREFORE for and in consideration of the benefits which will accrue to the City resulting by reason of the foregoing parcel being designated NTBA, and by reason of the develonment of the Urban Renewal Area in accordance with the Urban Renewal Plan by the Agency, the City hereby agrees as follows: "SECTION I - The City will conform to the Urban Renewal Plan, Downtown Civic Center, Project- Kentucky R-30, in its use of the above described parcel respecting any change, repair, modification, improvement or reconstruction of imnrovements located thereon and 753 resnecting all covenants contained in said Plan relating to lease, assignment or transfer of said nronerty and construction and maintenance of imnrovements thereon. "SECTION II - The City will at all times during the effective term of the Urban Renewal Plan conform with all existing Federal, State and Local rules, regulations, laws, and ordinances relating to the use and maintenance of imnrovements upon said parcel. "SECTION III - The City will continue to maintain the existing improvements, or any new or modified imnrovements constructed unon said parcel, in such a manner so that said imnrovements will at all times be comparable in structure, design and maintenance to other improvements made to other parcels within the foregoing Project Area and at a standard not less than that which the City has maintained imnrovements on this parcel prior to this Agreement.
