A RESOLUTION GRANTING PERMISSION TO THE ELECTRIC PLANT BOARD OF THE
CITY OF PADUCAH, KENTUCKY, TO EXERCISE THE POWERS GRANTED IN KRS 96.570((1)
CONCERNING CITY PROPERTY AND CONDITIONS IN CONNECTION THEREWITH .
WHEREAS, on July 6, 1965, the Electric Plant Board of the City of
Paducah, Kentucky, adopted a resolution having the following title: °A
RESOLUTION REQUESTING THE BOARD OF COM415SIONERS OF THE CITY OF PADUCAH,
KENTUCKY, TO EXERCISE THE POWERS GRANTED IN KRS 96.570(1:) CONCERNING CITY
PROPERTY AND CONDITIONS IN CONNECTION THERE1ITH°, and
h7iEREAS, Section 96.570(11) of the Kentucky Revised Statutes provides
that permission therefor be obtained in writing from the governing authority
of said city.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Board of Commissioners of the City of Paducah,
Kentucky, being the governing authority of said city, does hereby grant
permission for the Electric Plant Board of the City of Paducah, Kentucky,
to construct, own, lease, operate and control any and all works, lines, build-
ings and other facilities across, along, or under any street or public highway,
and over any lands which are now or may be the property of said city.
SECTION 2. In exercising the permission granted as set forth in
Section 1 hereof, the Electric Plant Board shall, however, at its osm expense
restore any such street or highway or other city property to its former
condition and state as nearly as may be possible and shall not use the same
in any manner as to impair its usefulness or to interfere with or obstruct
the maintenance thereof.
SECTION 3. This Resolution shall be in full force and effect from
and after its adoption.
