HomeMy WebLinkAboutOrdinances Book 15, Page 261, No Resolution NumberA RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY, DETERMINING THAT IN THE INTERESTS OF THE PUBLIC HEALTH, SAFETY AND GENERAL WELFARE OF SAID CITY AND OF THE CITIZENS AND INHABITANTS THEREOF IT IS NECESSARY THAT A PROJECT BE UNDERTAKEN FOR THE RELIEF OF OVERLOADED COMBINED SANITARY AND STORM :NATER SEWERS AND FOR THE CONSTRUCTION OF ADDITIO. AL SANITARY SEWERS; DETERMINING THAT SAID PROJECT SHALL BE FINANCED THROUGH THE ISSUANCE OF SAID CITY'S REVENUE BONDS PAYABLE AS TO PRINCIPAL AND INTERE SOLELY FROM SANITARY SEWER SERVICE CHARGES; DIRECTING THE CONSULTING ENGINEE TO UPDATE AND SUBMIT AS SOON AS POSSIBLE THEIR ESTIMATE OF THE COSTS OF SAID PROJECT AND OF INCREASED RATES AND CHARGES FOR SANITARY SEVIER SERVICE NECESSARY TO AMORTIZE SUCH PROPOSED REVENUE BONDS; AUTHORIZING THE CONSULTING ENGINEERS TO PROCEED 'KITH THE PREPARATION OF WORKING DRAWINGS AND SPECIFICATIONS TO IP•9PLEMENT REPORTS PREVIOUSLY SUBMITTED; AND DETERMININ THAT INCREASED RATES AND CHARGES FOR SANITARY SETTER SERVICE SHALL BE IMPOSED AND MADE EFFECTIVE IN ACCORDANCE WITH THE RECOMMENDATIONS OF THE CONSULTING ENGINEERS AND THE FISCAL AGENTS, IN ORDER THAT FUNDS MAY BE PROVIDED FOR PROGRESS PAYMENTS TO THE CONSULTING ENGINEERS, AND IN ORDER TO REDUCE THE AMOUNT OF THE PROPOSED BOND ISSUE. WHEREAS, a substantial portion of the City of Paducah, Kentucky, was severed many years ago through the construction and installation of sewers for the combined purposes of draining awav not only sanitary sewage (polluted wastes), but also storm waters; and WHEREAS, by reason of the natural growth and develop- ment of the City, said combined sanitary and storm sewers are now completely inadequate: and upon the occasions of heavy rains the same are constantly overloaded with storm water, so that in numerous places there are overflows into streets and basements some- times standing for hours at a time, containinP an unacceptable pro- portion of polluted wastes, presenting a constant menace to the public health, safety and general welfare, and materially interrupting the flow of traffic on the streets and other public ways; and WHEREAS, by reason of such overloading and overflow of the combined sanitary and storm sewers there is an ever present potential of epidemics of those infectious diseases which are related to the presence of polluted sewage wastes, constituting a menace not only to the persons residing in the immediate vicinity of such ponding areas, but also to all other citizens and inhabitants of said City and its environs; and WHEREAS, the City has heretofore employed Burns & McDonnell, nationally known Consulting Engineers of Kansas City,. Missouri, to make studies of the aforesaid problems and to submit reports and recommendations regarding the solution thereof, the 262 estimated costs, and the means of financing the same; and such reports and recommendations have been submitted and have been thoughtfully considered and discussed by the Mayor and Board of Commissioners; and WHEREAS, the City has heretofore employed as its Fiscal Agents Stein Bros. Fc Boyce, and The Kentucky Company, Municipal Bond Dealers having offices in Paducah, Kentucky, and having wide experience over a period of years in the financing of public projects and under- takings throughout the Commonwealth: and the recommendations of said Fiscal Agents have been thoughtfully considered and discussed by the Mayor and Board of Commissioners; and WHEREAS it is the opinion and iudement of the Mayor and Board of Commissioners that there is no feasible way to solve or reduce the gravity of the aforesaid problems except to undertake the construction and installation, as recommended by the Consulting Engineers, of additional storm sewers having for their sole purpose the interception of excessive storm waters when heavy rains occur, in order that the existing combined sanitary and storm sewers may effectively serve the purpose of draining away polluted •rater wastes; that the best, fairest and most feasible method of financing the costs of such installations, and of installinu additional sanitary sewers in areas where sanitary sewer service is not provided at this time, will be through authorization and offering at public sale of the City's Sewer Revenue Bonds and the imposition and collection of increased rates and charges for sanitary sewer service to whatever extent may be required in order that principal, interest, and the expenses of operation and maintenance may be paid solely from this source; and the Mayor and Board of Commissioners are sufficiently advised, NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY, HEREBY RESOLVE, AS FOLLOWS: SECTION 1_ It is hereby determined and declared that the constant overflowing of polluted sewage wastes in the City of Paducah, Kentucky, upon the occasion of each heavy rainfall, is attribut- able to the overloading by storm waters of the combined sanitary and storm sewers in said City; that such condition is a recurring menace to the public health, safety and general welfare of saidCity and of all the citizens and inhabitants thereof; that it is also necessary in the public interests to construct and install sanitary sewers in areas where sanitary sewer service is not presently provided; that steps and procedures looking to the relief of these menaces may 263 not he postponed; that financing of a project for such purposes, as recommended by the Consulting Engineers and the Fiscal Agents, shall be through the authorization and public offering 6f Revenue Bpnds payable as to principal and interest solely from the sanitary sewer service rates and charges; and that in order to accomplish all of the foregoing it will be necessary to impose and collect, immediately upon receipt of final recommendations, increased rates and charges for sanitary sewer service, in order (a) that funds may be made available for progress payments to the Consulting Engineers for their extensive work in the preparation of working drawings and specifications, and (b) that to the extent moneys from this source are applied to the costs of the project prior to the time when it is appropriate to issue the Revenue Bonds, the size of the Revenue Bond issue may be reduced at a substantial saving in interest costs. SECTION 2. The Consulting Engineers are hereby instructed and directed to review their most recent studies and reports and to bring up to date, for submission and consideration by the Mayor and Board of Commissioners as soon as possible, their estimates of the costs of the project, their projections of the expense of operating and maintaining the sanitary sewer system and sewage treatment plant, and their computations and projections of a rate or schedule of rates of increased rates and charges for sanitary sewer service necessary to make feasible the financing of the project through the issuance of Revenue Bonds. SECTION 3. Upon later authorization of this Board the Consulting Engineers will be authorized to commence and carry forward with all possible dispatch the extensive and time-consuming work of preparing working drawings and specifications in order that the City may be in position to solicit upon completion thereof competitive bids for the construction and installation of such project. SECTION 4.. A certified copy of this Resolution shall be transmitted by the City Manager to the Consulting Engineers and to each of the Fiscal Agents; and the Fiscal Agents are instructed to undertake any preliminary preparations for Revenue Bond financing of the project as may be feasible at this time. SECTION 5. This Resolution shall be in full force and , effect .from and after its adoption, and shall he published in full in The Sun -Democrat, the newspaper published in Paducah, Kentucky, and having the largest circulation therein, notwithstanding that there is no requirement of law for such newspaper publication. 264 ADOPTED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY, at a meeting held on March 9, 1964.
