HomeMy WebLinkAboutOrdinances Book 15, Page 1146, No Resolution NumberA RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A PURCHASE CONTRACT 4dITH GUTHRIE MAY FOR THE PURCHASE OF CERTAIN PROPERTY ADJOINING BROOKS STADIUM PARK, AND PROVIDING FOR THE TERMS AND CONDITIONS OF SUCH PURCHASE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager he, and he is hereby, authorized and directed to enter into a purchase contract with Guthrie May and wife, Alice May, for the purchase of certain land owned by Guthrie May described eenerally as follows: Being'in the City of Paducah, Kentucky, adjoining property of the City known as Brooks Stadium Park, bounded by same on the north, hounded by Brookhaven Subdivision on the east, bounded by Mississippi Street on the west and bounded by Seitz Street on the south. Being a part of the same land conveyed to Guthrie May by Mrs. Anna Schmidt et al, by deed dated June lE, 1951 and of record in Deed Book 303, page 18L in the McCracken County Court Clerk's office. Less and except that part of same included in the dedication of 25th Street, the boundary line of said property being shown in Block Map Book 4, page 47 in the office of the City Engineer. SECTION 2 The terms and provisions for the purchase of the land set out in Section 1 hereof are as follows: (a) The total purchase price of "40,000.00, with a deposit of $2,500.00 as earnest money which is to be applied upon the purchase price upon the delivery of the deed. (b) In the event the title is not approved by the Corporation Counsel of the City of Paducah such deposit money will be promptly returned to the City. (c) It is to he further understood and agreed that the purchase of the land set out in Section 1 hereof is contingent upon the said land being approved under the Open -Space Program of the United States of America and in the event such approval is not granted, the purchase shall not be made and said deposit will be returned to the City. (d) The length of time required for the consummation of the herein purchase shall he a period of not more than one year from the adoption of this Resolution, and if it is not possible to consummate same within such time, the said Guthrie May is to be released from the purchase agreement and the aforesaid deposit of $2,500.00 is to be returned to the City. 1147 SECTION_3_ The deposit and purchase price as set out in Section 2 hereof shall be paid from the Public Works Cumulative Reserve fund of the City of Paducah. SECTION 4. This Resolution shall be introduced and remain on file for at least one (1) week for public inspection in the completed :- form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter. _t �io7' c-'� �y.
