HomeMy WebLinkAboutOrdinances Book 14, Page 778, No Resolution NumberA RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF PADUCAH, KENTUCKY, TO ENTER INTO A CONTRACT WITH BIBLE BAPTIST CHURCH OF McCRACKEN COUNTY, KENTUCKY, FOR PERMISSION TO CONNECT TO THE SEWER SYSTEM OF THE CITY, AND PRESCRIBING(:THE TERMS, COVENANTS AND CONDITIONS OF SUCH CONTRACT BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor and City Clerk be, and they are herebry authorized and directed to enter into and execute, on behalf of the city of Paducah, Kentucky, a contract between Bible Baptist Church of McCracken County, Kentucky, and the City, granting permission to connect to the sewer system of the City, in words and figures as follows: "THIS CONTRACT AND AGREEIENT made and entered into on this the day of , 1962, by and between BIBLE BAPTIST CHURCH of McCracken County, Kentucky, and FRANK BRIDGES, LAWRENCE GRIEF And EV,;RUTT ODOM, Trustees of said Bible Baptist Church of McCracken County, parties of the first part, and the CITY OF PADUCAH, KENTUCKY, party of the second part W I T TSI E S S E T H "That whereas parties of the first part are owners of certain land situated and being in the Cit,r of Paducah, County of McCracken, State of Kentucky, described as follows: Being Bot Ho. 1 as shown by plat of subdivision of William Flannagan of record in Plat Book "G" page 80, McCracken County Court Clerk's office. Being the same land conveyed to J. E. Staley, Frank Bridges and J. D. McIntosh, members of the Board of Trustees of the Bible Baptist Church of T•IcCracken County, Kentucky, by WilliamFlannagan and wife, Lois Flannagan, by deed dated June 23, 1962, and of record in Deed Book 435, page 436 in the afore- said Clerk's office. The aforesaid J. E. Staley and J. D. I4cIntosh, former trustees of Bible Baptist Church have been properly replaced as such by the said Lawrence Grief and Everitt Odom. Whereas parties of the first part desire to connect said property by a sanitary sewer to a sewer of party of the second part at Tenth and Pine Streets in the City of Paducah. Now for and in consideration of the further terms, covenants and conditions the party of the second part does hereby grant to the parties of the first part permission to connect said property to said City sewer at the existing manhole at the intersection of Tenth Street and Pine Street, with a six inch vitrified clay pipe sewer, which terms, covenants and conditions are as follows: 1. Such connection shall be made at the extire expense of parties of the first part, and all work in connection therewith shall be per- formed by a contractor licensed to do business in the City of Paducah, and one who has filed with the Board of Commissioners satisfactory liability insurance policies and indemnifying bonds required by ordi- nances. 2. Said sanitary sewer is to be laid in the grass plot of the City insofar as same is possible. 3. Upon placing said six inch sanitary sewer in service the parties of the first part will pay the customary monthly sewer service charge as required by ordinance. 4. All necessary maintenance and repairs to such six inch sanitary sewer shall be done by parties of the first part at their expense. 5. In the event the sewer system of the City is extended to serve the above described property the parties of the first part bind and obligate themselves, their successors and assigns that within one year from the date of the construction of such sewer system they will connect the above property to such sewer system and sease using the connection_ authorized herein, and will pay to party of the second part the hook-up fee provided for by ordinance as to connections in sych area. 6. All terms and conditions set forth herein shall be covenants running with the above described land, and the parties of the first part bind themselves, their successors and assigns that in the event of violation by them, or any of them, of any of theterms, conditions and covenants herein, the party of the second part shall have the right to with -draw and cancel the privileges granted herein and cause said six inch sewer connection line to be disconnected from the aforesaid sewer system of the City.
