HomeMy WebLinkAboutOrdinances Book 14, Page 738, No Ordinance NumberAN ORDINANCE AUTHORIZING THE CITY MANAGER, ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY, TO ENTER INTO A CONTRACT WITH G. ANTHONY JOHNSTON AND ASSOCIATES, ARCHITECTS, FOR THE PREPARATION OF PLANS AND SPECIFICATIONS FOR REPAIRS TO NOBLE PARK BATH HOUSE, AND SETTING FORTH THE TERMS AND PROVISIONS OF SUCH CONTRACT BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager be, and he is hereby, authorized, on behalf of the City of Paducah, Kentucky, to enter into a contract with G. Anthony Johnston and Associates, Architects, for the preparation of plans and specifications for repairs to Noble Park Bath House, which contract is in words and figures as follows: "The City of Paducah Paducah Kentucky hereinafter called the Owner, and G. Anthony Johnston & Associates, herein after called the Architect, hereby agrees as follows: "I%MEREAS, the Owner intends to construct repair to Noble Park Bath House and whereas the Owner has employed the Architect to render professional services in connection with proposed work. "NOW THEREFORE, in consideration of the payment pf the fees hereinafter provided to be paid by the Owner, the Architect agrees to furnish and perform the following professional services in connection with preparing required plans and specifications for the construction of said alterations to Noble Park Bath House. "1. PRELIMINARY PLANS, the Architect shall prepare preliminary plans for the Owner's approval for the repairs. The Architect's estimates shall be regarded as approximations and the Architect can assume no responsibility for their accuracy. "2. CONTRACT DRAWINGS, prepare general working drawings and specifications for the construction of the alterations. "3. LETTING CONTRACTS, draft advertisements, if necessary; receive and tabulate bids, advise as to letting contracts, and drafting forms of contract. "4. DETAILS AND SHOP DRAWINGS, prepare necessary full size details -and check shop drawings. "5. SUPERVISION, the Architect shall provide adequate construction supervision until the project is accepted by the Owner; issue certificates of payment to contractors; make final inspection for acceptance of work. The Architect shall guard the Owner against defects and delinquencies of the work of contractors but he does not guarantee the performance of their contracts. The Owner shall award the building contract only to reliable contractors. 739 "ARCHITECT'S FEE, the Owner agrees to pay the Architect for the above mentioned sercices a total of Six (6%) Per -Cent of the final contract price and any subsequent change orders. "The total cost of the building used to arrive at the Architect's fee shall include the cost of all mechancial equipment and fixtures made from the Architect's drawings or purchased under the Architect's supervision provided that the Architect's fee shall not be included in computing the cost of said building. "Should materials and labor be donated during the course of construction or should the building be constructed other than on a contract basis the fair market value of the completed work shall be used for the purpose of determining the Architect's fee. "PAYMENTS, whether the construction be entirely executed or whether its execution be suspended or abandoned in part or in whole, payments to the Architect for his fee are to be made as follows: "Upon completion of preliminary drawings a sum of One & Ond- Fourth (14%) Per -Cent shall be paid on basis of the agreed estimated cost of building for which preliminary work is executed. "The Architect shall not proceed beyond the preliminary drawing without written instructions. "Upon completion of contract working drawings and specifica- tions a sum of equal to Three & One -Fourth (3K Per -Cent of agreed estimated cost is due. After awarding of the contracts the fees for the preliminary work and the working drawings and specifications shall be adjusted to an amount equal to the above mentioned per- centages as based on the awarded contract sum. "The Architect will not proceed beyond the working drawings without written instructions. "Should the project be delayed or abandoned after the plans I and specifications have been completed and approved by all parties i concerned, the Architect shall be paid a fee based on Four & One - Half (4W Per -Cent of a reasonable agreed estimated cost of i building for which contract drawings and specifications have been I. prepared if bids are not taken and if bids are received on the lowest legitimate bid. "Supervision. The Owner agrees to pay the Architect for the above mentioned services in Items 4 and 5 a sum of One and One -Half UW Per -Cent of the final cost of the building. it "DRAWINGS, the drawings and specifications, as instruments of service, shall be the property of the Architect.
